Mogley,

The old fix and sell line is a closely held belief by guys who have had to live with a shonkily repaired car. However, if you're **** about it and keep taking it back until it is 100% there's no reason why your car should be sub-standard.

If you're at all concerned about the quality of work done, take it to an independent smash repairer and pay him $100 or so to assess the work done.

It's a matter of being insistent about your rights to proper repairs. You're insured so use it.

New Developments:
The insurance company has just told me that they are getting Pickles to estimate the salvage value because it may be a total-loss?!

Am i missing something here? The damage cannot have been that bad ...

My repairer quoted $20k and therefore I think my insurance company want to see if they can salvage my car for an amount such that deducting my agreed value payout and the salvage income, they are forking out less than $20ks.

God dammit. I don't have time to look and search for another 8!.

My car was so beautiful.

Sigh.

EDIT: I was reading my policy and says if my car is a write-off, the policy comes to an end. I paid my hefty premium for 2 months. And there is no re-imbursement for the unused portion of the premium.

So if it is a write off I'm up for stamp duty and a new premium.

This blows.

What was your premium?

Oh hang on, you're only about 21 or thereabouts aren't you? Must be steep.

Hmm, just remembered what I was driving at 21. Nup, no sympathy left. Suffer.

It's daylight robbery. If 21 year olds ran the country I can assure you nobody over 50 will have health insurance and for those lucky few that do, we will charge them a mint for such privileges.

"Hi this is Jody speaking how may I help you?"
"Yes, i'd like to take out insurance for my teeth"
"Ok Sir how old are you?"
"Fifty F.."
"Sorry we can't help you, try JustRipoffCauseYouHaveNoChoice Insurance they may be able to help you"

Mogley, sorry to see your car and the damage. However don't you have some right of reply to them? Who are you insured with? I have to say that when I was 21 I was driving an Alfa Romeo and everyone was narky with me then too. So to those who were driving "sh*t mobiles" at that age, suffer on in silence. I would say that you could try to reason with the insurance company and get them to tell you why they are looking at selling the wreck. You paid them to insure you now make them do their work you are the one in control here really I think.

I can relate to you but only $1500 damage on my car and I got this fixed with a good reputable repairer who was referred to me by the dealer who sold me the car. He had his reputation and other parts of his anatomy riding on his advice. I made them aware that this car was my car and it was perfect and they would make it perfect again. I also made this quite clear to the assessor who came to look at it. Now the car is back and all perfect and I got a new set of number plates out of the deal as well. I was lucky.

However,

At the end of the day my dear I think that you have maybe learnt a valuable lesson in life. It's unfortunate but, you made an error of judgement in your driving, put yourself and the other driver at risk and have got out of it quite cleanly really. You are alive, the other driver is alive and you have lived to tell us the tale. You might have to look at getting a slightly cheaper car and then moving on to an 8 when you can afford one. Then you can drive it and insure it without having a mortgage on it. There are so many cars that won't cost a fortune to insure or run that will apease you till an 8 comes along again.

Good luck, it's a harsh world out there and you just found that out I spose.

Ciao'

After further thought I would think that you should invest some of your money in a driver training course. I re-read your post. The mistakes you made are all classic mistakes made from inexperience and lack of hindsight.

You are lucky really.

1. You turned right in a no right turn on amber (first mistake)
2 You turned even though you had impeded vision from another vehicle
3. You didn't take notice of the fact that caution should have been paramount
4. You were driving tired which affects your mental capacity (known fact)
5. You admit that you were wrong so why complain.

You are lucky that you were hit by another car at low speed it could have been a truck trying to skip the light.

My thoughts go now to the other driver who is elderly and will fair far worse from your mistake than you will, they don't bounce back as easily as a 21 year old. Think about it more and thank your lucky stars mate. You might have the police mentioning a few things to you too.

You may find my response harsh but you put your situation out there for others to comment on and these are my comments

Sure I understand your point.
The insurance company has told me the salvage value is such that they will probabaly repair my car but I will have to wait till Tuesday. If worst comes to worst I will take the issue up with them further if they try to sell my car.

Apart from that, about the driver inexperience, more than lack of experience I think it was more a case of over confidence. As drivers of a high-powered vehicle we are all subject to over confidence and thinking you are a better driver than most people on the road. I certainly thought I was "invincible" in my 8, as do a lot of drivers here, regardless of experience.
You could argue that is driver inexperience, but we are all inexperienced drivers to a certain extent depending on how you define "experience".

Nevertheless, I do thank my lucky stars the accident was not severe and in a way when I feel anger and start acting irrationally about the accident I remind myself of how much worse it could have been and that hopefully this accident has changed the way I drive and will avoid future accidents.

I don't think driver training could teach me anymore than that RTA book does to get your Gold licence. It's all just pen and paper in one ear out the other, don't speed, don't do this, don't do that. We wouldn't drive the RX8 if we had to granny it around everywhere and tried to follow every single rule. I don't think you can have 'spirited' driving and stick to the speed limit. Every now and then we bend the rules we are so aware of and that day just happened to be one of those days. (Even though I didn't actually know it was a no right turn until the last moment)

Mogely I think you show a lot of maturity in your response. But I have to disagree with you. You can drive the 8 spriritedly up to the speed limit and then back off. I love driving my 8 but the roads not a track, it's not a place that's predictable. The track is! Believe it or not it's also quite safe.

If you want to drive it and learn how to drive it to the max then get out to the track and learn what the car can do. I get frustrated and want to go beserk in the car believe me. That's when I go to the track and take out all my driving frustration in a safe and responsible manner!

Good luck though hope it all works out for you. I remember when I was as emotionally attached to a car and I'm a chick! It passes when you lose them or realise you have to sell them.

Drive safe and take care.

Julia

Does anyone know how long it takes for parts to be imported?

I think the car may take a long time to fix because the parts may not be available locally.

I called Mazda and they told me it may take up to 8 weeks??

8 weeks sounds like a long time. I've had to wait for parts to be imported in the past (not for the RX8) and it's usually less than half that time.

Perhaps they do not have some parts in stock atm and have to wait for them to be manufactured and delivered by component suppliers??

ahhhhhh... I am getting this.

8 weeks is a very long time and I thought that MA would keep every part so that they can make an RX-8 if they wish to... minus the ECU me thinks

Ok thanks for the advice guys. I was hoping that wasn't the case. I can't live withouit my 8 for much longer...

Maybe the guy was a little bit misinformed, i'm going to speak to my mechanic/smash repairer ASAP once the assessor gives the green to fix it. ( If there is no mechanical damage, in which case, write-off)

I got the car back over a month ago now.

Surprised to this thread back.

Very happy with the job done. The recommended repairer was professional and top blokes for mechanics. I didn't have many issues so not sure what they would be like if you got under their skin a little but the car looks great.

Only problem I have is the new suspension hasn't settled yet and makes my car scrape in weird places I didn't used to scrape. But that will settle over time.

Almost forgot I got into an accident few months ago.. Don't want to go there again.

Did the police come out to investigate?

Remember you have to report it if 1 of 4 things happen:

Any vehicle towed (AKA undrivable from the scene)?
Any driver under the influence of an intoxicating substance?
Any persons killed of injured?
Anybody fail to exhchange particulars?

If damage was under $2,500 in parts, there were no injuries to persons or property, and you exchanged name and addresses there is no requirement to report it to the police. Mind you thats not stopping the other party from reporting it without your knowledge.

The police have 12 months to prosecute. If nothing happens before 7/8/07 you can breathe easy.
