Posted in RX8club.com...I'm looking forward to the outcome on this. I have to agree with Dave, one last ditched effort is required before taking it further. It just seems to be we are the ones who have to forever dig up and chase up recalls, and when we get screwed over by their service departments they blame you for their mistakes. Surely the Trades Practices Act come into being here, but even then there are very few laws with teeth to protect the customer.

Going to a Mazda service centre these days is like playing russian roulette...there are many dealerships who apply the rule for one, and not others. I have spent a fortune with Mazda over the past 8 years (120K+) and not only has my recent treatment has been woeful, but I have real concerns for the future of my car.

I have had a lot of experience with customers over the years, and one thing which dosen't change is the power of perception. If a person has a good experieince they will tell a handful of people, a bad one will tell three times as more. They should not have the satisfaction of a win, and in the aftermath of their incompetence and experiences, politely tell them if the issues arn't fixed we'll go elsewhere.

I have just emailed John Read at MA with the link to Leftlanenew.com article for a response.

It has been 2 days and I have yet to hear from Mr Read concerning previous email.

I would just like to say to you guys that I am not on any vendetta with Mazda Australia, Mr Dickson or John Read or anyone for that matter.

I just want a fair and professional deal for all of us, and I will continue with my quest until we can get an equitable response.

The only time Mazda Australia will react positively to our concerns is if / when the local regulatory bodies concerned with emmission etc come on board and are made aware of the issues relating to premature failing 02 sensors catalyctic converters ignition coils failures , and engine rebuilds .

Getting the regulatory bodies on board will force Mazda to act otherwise they will snowball deny and use delay tacticts , so as to get away with having to resolve this ongoing problem .

Totally agree Michael,

This is what I hope, repeat HOPE when I get back some news from said regulatory bodies on these conformities.

Then again We will be looking for actual cases with ALL the information to prosecute a case with MA and if necessary MMC Japan.

I am thinking perhaps a dedicated thread in these forums with a template for all those grieved to fill out (Australian owners Only),
Things like Owners name, Chassis Number, Date of purchase, mileage, Selling dealer and list of defects and the rectifications carried out while in warranty and after warranty has expired (depending on the circumstances), out of pocket expenses, etc.

I will be looking for input when ready and I predict we will need to run the thread for 6-8 weeks to gather evidence.

What do you guys think, I don't want to get too far ahead just yet.

Please correct me if this is not the appropriate legislation....

TRADE PRACTICES ACT 1974 - SECT 75AF
Liability for defective goods--loss relating to other goods
If:
(a) a corporation, in trade or commerce, supplies goods manufactured by it; and
(b) they have a defect; and
(c) because of the defect, goods of a kind ordinarily acquired for personal, domestic or household use (not being the defective goods) are destroyed or damaged; and
(d) a person who:
(i) so used; or
(ii) intended to so use;
the destroyed or damaged goods, suffers loss as a result of the destruction or damage;
then:
(e) the corporation is liable to compensate the person for the amount of the loss; and
(f) the person may recover that amount by action against the corporation.

TRADE PRACTICES ACT 1974 - SECT 74G
Actions in respect of non-compliance with express warranty
(1) Where:
(a) a corporation, in trade or commerce, supplies goods (otherwise than by way of sale by auction) manufactured by the corporation to a consumer; or
(b) a corporation, in trade or commerce, supplies goods manufactured by the corporation to another person who acquires the goods for re‑supply and a person (whether or not the person who acquired the goods from the corporation) supplies the goods (otherwise than by way of sale by auction) to a consumer;
and:
(c) the corporation fails to comply with an express warranty given or made by the corporation in relation to the goods; and
(d) the consumer or a person who acquires the goods from, or derives title to the goods through or under, the consumer suffers loss or damage by reason of the failure;

the corporation is liable to compensate the consumer or that other person for the loss or damage and the consumer or that other person may recover the amount of the compensation by action against the corporation in a court of competent jurisdiction.

TRADE PRACTICES ACT 1974 - SECT 75AZI
Certain misleading conduct in relation to services
(1) A corporation must not, in trade or commerce, engage in conduct that is liable to mislead the public about the nature, the characteristics, the suitability for their purpose, or the quantity, of any services.

Penalty: 10,000 penalty units ($1,100,000)

I just called Mazda Canada and they said we would be getting the extended warranty as well. Letters to RX8 owners would be coming out shortly, but the dealers have been informed. I checked with my dealer and he was informed on June 2 by email. Mazda is staging it in for some reason and you guys may eventually get it as well.

Hello John,

Mazda RX-8 Owners in Canada have now been granted the same engine extension warranty
as the US..

Mazda Motors UK is also being bombarded with request's from UK owners.

You both know that under (Australian Design Rules) ADR 79-80 Emission's Conformity after Jan 1, 2005
is 5 years or 100,000 KM, so at the very least you should be offering this warranty period to ALL Mazda Owners.

A RENESIS engine that does not conform to Your engine vacuum/compression test at say 4 years of age is in
breach of this conformity under Australian Design Rules 79-80.

As a club here in Australia we are contacting ALL members to partition Mazda Motors Japan.

Do you intend replying to my emails or ignoring them , as this issue will not go away

Theres no way i can see how Mazda Australia won't follow suit here. I'm presuming this will happen, so what in essence will it mean for us in terms of the warranty?

OK guys...

I have had a brief reply from John Read the Customer Services Manager at Mazda Australia to the email above^^...

He wants me to supply my phone number (which I am prepared to do) to discuss this issue.

Obviously he does not want to say anything in writing...

So we have the Long weekend to gather More evidence.

This is what I think should happen...

I WANT AS MANY OWNERS OF AUSTRALIAN RX-8's TO PM (PRIVATE MESSAGE) ME THROUGH THESE FORUMS....

I would prefer at this stage rather than "show" complaints publicly here to do so VIA a PM.

I am not trying to hide anything from Mazda Australia, but with short notice over the weekend I would rather collate "brief" summaries of your vehicles complaints to date.

SO, WHAT I NEED PERHAPS IS JUST YOUR RX-8's YEAR, MILEAGE, COMPLAINT, WAS IT RECTIFIED EITHER UNDER WARRANTY OR OUT OF YOUR POCKET ($$$) AND PERHAPS THE COST TO YOU.

PLEASE KEEP IT BRIEF.

I don't know what John Read will say to me, however, I feel I need some concrete information apart from what we already know about what has occurred in the US and their warranty extension.

SO PLEASE GET TO IT, PM ME AND YOUR MATES HERE AND GET IT TOGETHER....IF WE ARE TO SUCCEED WE NEED EVIDENCE.
AND PLEASE, I DON'T WANT TO HEAR THAT YOU HAD SQUEAKY BRAKES, OR YOUR SERVICE ADVISER WAS RUDE TO YOU OR DID NOT WASH YOUR CAR, OR THE SERVICE COSTS ARE TOO EXPENSIVE.

Over to you guys...OK.

BTW, I have a contact who has an ear in Mazda Europe, and our UK friends are also making approaches.

Obviously ALL Australian RX-8's.
Under the US policy of 8 years or 160Ks, if your 8 was sold in 2005 the extension would take it to 2013, this is for the internal engine core of rotor seals/bearings/oil control rings,etc.

Ash, I want Mazda to cover the costs of an engine test and certify the readings/results are within acceptable engine compression parameters. Is this good enough....?

I've only got rattles, clunks and squeaks, it doesn't mean my coils aren't up to the task, my rotors may have lost compression or my transmission is about to die! I'm out of warranty so I'm not taking my repairs to mazda so they can rip me off.

Mazda are not going to certify readings on a whim, you have to have issues with your car like, hard starting, excessive oil consumption, lacking power, rough idling.
These are some of the symptoms that Mazda USA use then they run their Vacuum/compression test, if it fails then a new engine is ordered.

Apart from that my friend if you don't have or have not had any problems like this then you are not what I am looking for.

I want the guys like Labby's experience, and those who have had engines replaced, and I know they are out these...lots of them.

Yes, my idling is not perfect as is probably the case for many others. Mazda will do an examination on my car and say I need new plugs, when I only got them 18 K ago. How do I also know my 48K engine is on the way out when the only way to determine this is with a compression test?

Under the rules of engagement if this dosen't qualify, then whats the bloody point of pursing this?

I am in an unfortunate position. I have now fitted turbo to my car, however prior to fitting the kit I had my car compression tested and it was found to be very low however I was out of warranty, so I decided if I was going to have an engine go kaput I may as well do it in style :D and I wasnt going to pay an extra 5k to have the engine pulled and rebuild on top of the turbo cost.

Further to that I have been through 3 sets of coils, one coolant overflow bottle and my gearbox has been bodgy since day 1.

Hang on mate before you get on you high horse, I specifically asked for FACTS, your last post which I replied to you were hardly facts but a statement.

How the hell am I to know the details of your idling, etc, unless you TELL me...which you have know done.

Even if your RX-8 is out of warranty...

DON'T EXPECT ME TO REMEMBER OR RECALL OR TO TROLL THROUGH ALL THESE THREADS TO FIND OUT THE ISSUES YOU HAVE WITH YOUR CAR..... Because I don't recall..

well how many people have experienced engine failure from this small sample of .au owners on rx8club.com?

how to we know if our idles and rattles are catastrophic and important when you are ignored by your dealer on these issues. I have a bad drive train rattle yet my dealer has taken three attempts to do nothing to fix it which is typical. I don't know what the problem is because the dealer cant or wont take the time to diagnose it properly.

Ash, my point was not being critical of you, but Mazda Australia who do not have a good track record of follow up. I will outline my idle and engine concerns. PM sent.

I was in my time and still is...

Mazda Australia and Mazda Japan wants their customer to approach their dealer with the issues they may have.

I understand many of you have been treated poorly both while under warranty and out of warranty.

Mazda America do tend to do things in their own way as they are not owned by MMC..like Mazda Australia.
MNAO are a third of Mazda's Business.

So the Japanese and MA tend not to Advertise issues they may have unless they are safety/mandatory...Recalls.

They prefer their customers to approach their dealers which is fair enough..this is where it falls down...you do not get what you think you are entitled to., or even the dealer is not aware of a fix because they don't read their Service Bulletins that Mazda sends them.

As far as I am concerned this is the difference between a good dealer and a bad dealer, I could not give a DAM about the "Buying" experience...car salesmen are a dime a dozen.

If I am going to pay a premium for a car ( and Mazda Owners do) I want SERVICE.

It Is the after sales experience which shows how good a product/dealer is.

My point is the Japanese and Mazda want to know your complaint...
what is your car doing...what are it's symptoms.

I have Never seen any manufacturer Trevor "certify or put in writing"
that a car or engine is within spec...they just won't do that.

But your Mazda experience would be satisfied in the knowledge that you have an extended warranty to cover the internals of your rotary.
