Ticket Help?

Long Read Sorry!

So to top off my wonderful day that had occurred yesterday I received a nice ticket for doing 126 in a posted 100. Normally I wouldn't bother me at all due to if I deserved the ticket then I would gladly pay for it and accept my wrong doing. But the way I received the ticket seemed a bit sketchy. I was driving with my gf to get a movie and I was following a car on the on ramp to get onto the 403. The car in front of me was traveling a bit faster (trucks + turning don't go to well so I was going fairly slow). The car in font slowed once we got onto the highway and I proceeded around him traveling at about 115 at the most. I continued to cruise down the road slowly creeping by cars. I passed about 7 of them and noticed an OPP cruiser driving in the front of the line. As I approached the front of the line in the passing lane I jokingly said to my gf "I hope he doesn't pull me over for passing him at 105." Needless to say when I went by him he tucked in behind me and flipped on the lights. He said he tagged me doing 126 coming onto the highway from the on ramp. This is the part that kind of had me shocked. I was clocked at 126 by an officer that was over 200m in front of me and had around 7 vehicles behind him, as well as I had a car moving faster than me in front of me as we merged onto the highway.

Are police able to get an accurate reading like this?
Should I just take the ticket pay it and be done?

I don't feel as if I deserved this ticket which makes me question the whole thing. Any help would be great.

Btw its 125$ fine and 3 points. Money isn't the issue, just the points kind of suck and the fact I dont deserve it.

I got my points dropped from 4 to 3... No difference... really... Don't think they will drop all... That was my first ticket in 15 or so years & they didn't drop the points...

Did you ask to see the radar read-out. If you asked for a court date on your ticket you should be able to see it if you ask the Crown Lawyer during the meeting before you are given a trial date.


If you were only curious if it was possible, I've been told the radar is 'reasonably' accurate out to around 750 meters or so. By reasonably the guy meant that it's off by factions of percent but after a undisclosed distance temperature, air pressure, humidity... start to factor in slightly. I have experience with surveying laser ranging equipment and also the laser ranging sights used by hunters and such. They have a built it error of about 0.1% over 1000 meters but are generally much less.

So, if the radar did have a clear line to your car, you were doing at least whatever he said you were. Doppler ranging radar ie radar guns only give the value of your velocity that is vectored directly at the unit. *Deep breath to get to the end of PHYS 201* The more of an angle between the line your car in moving in and the angle the gun to that line the lower your apparent speed will be.

Doesn't hurt to dispute it and plead your case to a judge. Go to court organized with your story straight and well documented...and then the burden of proof will be on the officer to say how he could tell you were going that fast.

Seems to be a lot of leeway in this to give the judge some discretion to question the speed

All i can say is fight it all the way!!!!!!!!!!!!! I got booked on a BS speeding charge where it was 60 and if you go down this dip it turns to 50 right away and they were there i was in my corolla. They tagged me going 87 in a 50 so they said i was going 37 over the limit and i had a 350 dollar ticket.. make a long story short i kept fighting it and going to court myself and in the end i asked for disclosure which the cop could not produce and the judge delayed the case again and the next date the cop didnt show....Fight it man!!!!! Fight it, chances are the officer isnt gonna show up.

If you're good in french, ask for a french judge on a friday afternoon. Chances are they will just dismiss it and if the officer doesnt speak french, you should be off the hook too.

(Never personnaly tried it, but I have some friends that are studying law/police foundations)

there is no accuracy and no way of proving that the officers radar actually picked up youre car, also the courts are real booked right now so its a good time to fight a stupid ticket, there are time statutes that are a part of our right as a canadian, in other words we can gtet a case thrown out if it takes to long to carry out the due process.....believe me when i say this.,,,i am a survivor of a bad ticjet due to it taking too long, stating my stress, time invested, anxiety etc....lol isnt it great...lol

soon if fantino has his way people will get tickets for having no undershirt on while operating a motor vehicle so it just gets better abd better...lol

I'd fight it if I thought I didn't deserve it.

I got pulled over going 46 in a 40mph and the cop gave me a street racing ticket. I was shocked. It was only 100 bucks but was also 10pts and i would have lost my license for a while.

I fought it and the judge didn't see how i could have been street racing. The cop also had all his facts mixed up and it was fun clearing it all up and actually proving him wrong. He was also a ***** when he pulled me over, so it felt good to win.

PS cop has to show up it is mandatory now, no choice unless he is sick he must be there..period.

Do they just make up things in ND? I live just north of you guys and I don't need any trouble if I decide to cross the border...how did he say 6mph over was 'street racing'?

He tried saying I was racing the guy in the lane next to me. We went to court, and I had to correct him on some of the facts of what actually happened. The cop was a noob. Only on the force for 1yr. usually kinda laid back. Been cracking down on loud exhaust tho. You should be fine tho if you ever come this way.

Appreciate everyone's input on this and I will more than likely take it to court. The distance thing isn't the part that I have in question, more of how can you radar me if we're driving in the same direction, and the officer has 7 cars between us.

One of my good friends is a State Farm agent. People dont understand insurance and tickets. Points are not the main issue with tickets and insurance. When the insurance company checks your driving record a ticket is a ticket to them. Could be for no seatbelt, speeding at 18 over, 21 over etc. If you get it reduced to 5kmh over, its still a ticket and its still on your abstract. The only way fighting the ticket that will benefit you (unless its a careless charge etc) is to have it withdrawn completely. As long as there is a fine paid/charge laid it will affect your insurance IF they check your abstract.

Yeah the insurance is the big problem on this, and it doesn't help that my dad is my insurance agent so him not finding out is slim. I would like to get it completely removed because I don't feel that I could have been targeted accurately with 100% guarantee it was me. The car in front of me was doing at least 10km/h faster than I was and he was in front of me which would make the radar catch him and not I would it not?

If I read this right, you could have been on the ramp, right out his passenger window as he went past? So your case should be about the other car, and ask him to show how he knew it was you. Was it broad daylight? Was the other car a similar colour to yours? Good luck!

It was at around 10pm, so it was dark out and I was in a full black Tahoe so kind of hard to see me at night. Car in front was a silver Lincoln car of some type if I'm not mistaken. He was already passed the ramp when he hit me with the radar. Like I said there was around 6 cars in front of me so he was atleast 6+ car lengths passed the ramp.
