Something is missing from this story.....

Cops don't care about the two other people saying the light was green. You have the right to stop your car without being rear-ended regardless of traffic signal color. What aren't you telling us?

If your story is complete then it sounds like you will easily overturn the citation in court.

Hmmm... I have to agree with bascho on this. Which state did this happen in? Most have a policy on rear ending another vehicle. I know here in Minnesota the majority of fault is given to the rear ender There is a percentage given to the person for being there as if they weren't there, there couldn't have been an accident...

I hate those percentages. I've heard that in some states that you are 10% at fault no matter what just because you happened to be in your car. Although I heard this applied to someone who had their car parked at the end of their driveway, some drunk guy was weaving down the road and in people's yards going down their street, smacked into the rear corner of the car. The tail light was broken and the bumper dented. I'm not sure what other damage there was. The insurance company ruled it was 10% their fault because their car was parked in their driveway instead of kept inside a garage even though the house had no garage and it was back off the street. I am pretty sure these people lived in Washington. The story was relayed by the parents of a teammate several years ago.

It is up to you to make the decisions about stopping/going through an intersection.

I think that in the Federal Manual on Uniform Traffic Control Devices, stop lights that are oriented into/from the sun (east/west) are required to have that ~3" black border/suround to help you see the light color/position when the sun is behind it.

Around here in the poor areas, that 'feature' is conveniently neglected. Without it, the light is basically obscured by the sun. So it is common sense to treat the intersection like a stop sign.


What would those morons do when/if the power to the lights go out, and the battery backup is exhausted?

Like other said, you have nothing to worry about. The rear-ender is always at fault. My friend rear ended a lady's car because she slammed on the breaks for no reason right in front of him in the middle of a freely flowing highway. His car was totalled, he was found at fault, and to top it off he also got a traffic ticket. Sucked for him, but you're on the right side here.

Well, sorry for the long delay before the update, but I went to court and got it reduced to unsafe driving (0 points), my lawyer suggested that battling the ticket wouldn't be worth it, as the monetary costs would be similar to the unsafe driving (400 total in fines).

Sorry to hear about the accident... I was in a similar accident, except I was the guy crashing into the car in front of me... To make a long story short, a car flew by us on the right and cut across 3 lanes of traffic 2 cars in front of me... Everyones on the brakes, I'm driving my buddys Ford Tempo... Yeah. Crash approx 30 mph. Luckily I hit a Saturn. No friggin' damage on their car... Awesome. His front was totalled. Good luck in court...

For no reason? I believe you are telling us the whole story as you know it, but something tells me your friend didn't tell you the whole story.
