Well what happens is when they total the car out the first check goes to the loan company. Whatevers left of the vehicles value goes to you. They keep the car. If you want to keep the car then you have to negotiate a buy back. Basically whats the cars value. You negotiate back and forth until you come to an agreement, they deduct that from your check and you get the car plus whats left over.
Now keep in mind that value of the car is negotiable, even if they tell you it isn't. Do not just accept the first offer. You need to go over the value of the vehicle and work on negotiating a real price. They will try to pay out as little as they can, but if you have done after market work, if you have custom parts, or racing parts you can get some of the value back. Its an aftermarket percentage. No matter what they tell you, it is negotiable and sometimes a lawyer can help you.

I thought you could refuse the total offer and still have the car repaired/get a check for the estimated repair cost.
Many will warn against keeping a car with a bent frame. If they want to total the car and you're able to get a good offer, I'd take the check and start with a clean car.

well thats why i want to try and take my floorjack and take a peek underneath to see if anything got tweaked. honestly i think it looks worse than it actually is and maybe the front and rear (definitely rear) is a little, er, tweaked, and that it just scraped pretty damn good onto that divider.. so the guy at the tow company is just talking out of his ***, "oh yeah its definitely totaled." i bet he hasnt even looked under it..

I guarantee that's totaled. If it doesn't get totaled, your insurance is not giving the proper value for the damage. My car required a lot less work than what your car clearly needs from the pictures and my car was just shy of being totaled with under 50k miles on it.
Even if you don't see any specific bending in the frame, it doesn't mean the frame is fine. There was nothing visibly wrong with my frame but it was bent and required adjustment. If they total the car, it would honestly be a very bad idea to keep it. It's better to just move on.

Happened upon this fly whip the other day on my way home from work. Apologies for the poor picture quality, hard to take a picture through my tinted windows using my phone.
These pictures don't do justice to the "matte" black paint scheme on this beast.

I try not to be a snob about cars, because I realize they're expensive and not everyone can afford one as nice as my 8. If you're a car enthusiast on a budget, and you want to put some wrench time and a bit of cash into your less-than-awesome car, then by all means, go for it. I am completely OK with it.
But when you have a car with a can of spraypaint job and it's just totally busted, why on earth would you go out and put a wing like that on it?! I just don't get it.

Spotted this the other day. It's worse than it looks though, as impossible as it sounds.
The front bumper appears to be from an Evo 10, or at least designed to look like an Evo 10, except it's also held on by more of the bungie cords that you see holding on the rear, but without a front spoiler, they are hooked up over the hood to the hood edge near the windshield.
...and...
They ran into something. Something like a tree or a pole, since it's smashed inward in the middle.
And that wasn't the first time. The rear wheels track about 6 inches to the right of the front wheels. And another dent visible around the right rear taillight.
And yes, that is a pile of garbage and papers in the back window completely blocking any possible rear view mirror viewing. And the driver side mirror is in the same fantastic shape as the passenger side mirror. Soo....no view behind them, at all.
