Even though I do not know either parties thoroughly enough to take sides, I can however state some observations from reading he 6 pages.
*The OP makes an organized log of events which is a plus, however I do not know the accuracy of the log
* Op paid with check which takes time to clear
* Op moved 3 times
* Op waited far too long before contacting MM on the issue.
* MM isn't very active in the thread which is a negative considering it's an accusation about his business practices
* MM communication from what is read is fairly poor which most likely caused the issue in the first place. It is the job of the seller to communicate with the buyer as much as it is of the buyer to stay in touch with the seller.
* Seller loses realization of the buyer paying him money for products
* Several complaints in thread from other parties not addressed by MM
Honestly, I tend to side with the buyer considering he's spending his money on a product that produces wealth for the seller. Poor customer service is not an option considering your livelyhood is based on the buyers. MM you tend to come off as an ***, no offense. I do not entirely know the other side of the story considering it's none present in this thread, but from bad experience with sellers in a multitude of fields this comes off as another story of the buyer not being able to contact seller and seller not acknowledging the problem. Then again, I had a bottle of champagne.

Im nuetral and have seen this **** go on toooooo long. Its ridiculous.
I think like this.... When you order custom wheels from JAPAN (work,adv,volk) etc., you have a couple of months to wait for several reasons.... from my experience 8 months..... You are willing to wait for that product for that long for what its going to provide you with (looks/performance).
I think the same with the COBB AP with MM tunes. If the wait time was 4 months... people would wait. Unless they go and get an AP without the tunes... which is up to them.
If someoone is new to the thread and has already bought an AP and now feels assed out or worried... thats on them. Its the risk you take when you buy any product online, over the phone, through television, etc. You can place the order and pay and somehow your product arrives at your door broken or not at all and go stolen somehow. What can you do? Bashing on another forum member might only make things worse for yourself, and you can end up looking like a DUMBASS or get BANNED for the comments you make. (talking from experiences)
If you buy an AP with MM tunes. You're going to wait or maybe not. Do it... or dont. Its up to you.
edit: Ive met MM in person several times... and he's not a BAD GUY... but this thread should be renamed to "You might have to wait for an AP"

It appears that civil, non-threatening posts and replies, on-topic, with no cursing or name calling, made *in the best interest of the community*, are no longer allowed.
It also appears this forum sides with it's paying "vendors" (I use that term loosely) over the needs of the members (obviously there is a need for some form of representation or intervention).
Obviously the staff here can run this forum the way they want and none of the lowly "members" can do anything to change that. However we will all be forced to endure more of these threads in the future, though, which is the real shame. I thought the mission of these forums was to support the member community, and not the vendors.
Since some posts are now missing, for the record, MM made his first appearance in this thread in about 6 weeks in response to my statements, after ignoring all other posts by members or customers. Unfortunately he did not see fit to respond to the customers and members requests that he should have, but at least we got him in here.

i run a shop and i know what its like to have a customer with an "issue". i am USUALLY genuinely concerned but without having all the facts/info on the matter sometimes there is only so much you can do. i have found that communication is the key. MM took a minute of his time to answer a question i had (on a different thread) that alone was enough to earn my business in the future. i think all that people are really looking for is some kind of acknowledgment of there "problem" and some attempt at a solution and this thread could, for the most, part be put to rest. BUT YOU CANT PLEASE EVERYONE NO MATTER HOW HARD YOU TRY

If anyone cares, MazdaManiac is the best RX-8 vendor I've had the pleasure of dealing with.
I've bought the AP from him, as well as the 3071R turbo upgrade kit, upgraded fuel injectors, custom tuning, etc. He has always gone out of his way to help both in real life and on the forums.
