Marsplay....good guy again

Well I'm having some serious issues with Marsplay, I own a Mazda 6, and joined this forum to purchase some 16" Wheels that he was selling. I contacted him at the end of May, and ended up sending the payment (money order) on June 1st. I emailed him a few days later with no response, June 12th comes around and I was told he was out of town, but he did recieve the money order. 11 days was plenty of time, especially after being told the wheels would ship the day payment was recieved.
I kept asking for a tracking number and said he was busy, would ship the next day....got this excuse for a week. Checked back with him and recieved an email on June 22nd saying he just got out of the hospital, but would have them shipped early this week. (When he says early, I expect wednesday at the absolute latest). I've emailed him twice over the past 3 days and still no response. Now, I didn't want to bring this out on here (obviously by waiting so long), but I'm just fed up. I was going to use these in an autocross July 9th, well I doubt I will get them for that. I've asked for a refund, or them to be shipped immediately with a tracking number.
The only reason I purchased from him was because he was labeled as a so called "Good Guy", well even if I do recieve my refund/wheels, he still needs to be labeled as a bad guy, there is no excuse for this, he had plenty of opportunities before he went in the hospital. Any thoughts to take care of this situation, what options do I have, can I file a police report? I'm currenty in college and really can't afford a $230 hit to my wallet without gaining anything from it, and I'm sure many of you would be in/or could have been the same way during your college years (and currently as well).

ouch sorry to hear that. i was probably the first to deal with marsplay but its cause he purchased something from me. but from others i heard many bad news about marsplay and his incidents. i hope all works out.

Yeah, I found information on filing a police report where he lives. I hope it doesn't come to that, but if I don't hear anything by this weekend I will file a report on Monday. I honestly believe he has the wheels, but I just don't know if he quite understands what the word "today" or "immediate" mean. 1 month is neither today or immediate.

Yeah I have his address, he lives in Elk Grove, CA to be more specific. I also looked up his phone number, but of course its not in operation anymore. Its funny because I was trying to prove my credentials to him (6club posts, ebay) but I trusted his reputation because of his join date, and the few topics (including this one) that said he was a good guy. Anyone in the Elk Grove area with a phone book that could look up a current phone number for him (just in your local phone book if its more up to date than Yahoo People Search). If you PM me I'll give you his name to look it up. I'd appreciate it a lot. I really don't want to go through all the hassle and take legal action, but if it comes to it I will.
**Edit: I found his cell phone number in one of his posts on here, I'm assuming its really his, I left a voicemail. I also found another email that he uses, hopefully he can begin to understand how serious this situation is to me through my continious effort to contact him.

Good News!
I had a member of 6club and here pick up the wheels and ship them for me, he picked them up this morning and will ship them this evening. Like I said before, I can't label Marsplay as a "good guy", but the man is certainly not one to scam, just procrastinates. From what it appears I may have gotten out the quickest with him as I've heard from other members 3 months was typical. I'm just so glad this is resolved, and a huge thanks to Hoosten for picking them up and shipping for me.
