rx8evo & Riken misunderstanding and overreaction Paypal Dispute

rx8evo & Riken misunderstanding and overreaction Paypal Dispute

Upon receiving the tailight I sent to Riken, he files a paypal dispute that the item received is not as described and broken.

Item was boxed and double bubble wrapped and shipped suspended in packing peanuts, shipped via USPS delivery confirmed. If item had arrived in any manner than as shipped he should have contacted me. The very last thing he said to me before receiving the item was, "So far you've been a great seller."

So why does he does not:

1. Call me
2. PM me
3. email me

The attempt to rescind payment on an item received in the manner as described without contacting the seller in regards to a claim before hand would suggest that he had intended to fraudulently receive an item without paying for it.

I have escalated the matter to Paypal as they have proof of correspondence, delivery, and photographs, and have now put the burden of proof on the buyer: Riken - Jose Chavez

Very minor abrasions from normal wear, but nothing wrong with the tail lights.

The passenger side tail light has been smoked, as you will see in the pic below, and the driver's is still clear.

Because I live in Arizona and you're in North Carolina, I can't include the shipping at that price, but I will sell the driver's side tail light to you for $45 + shipping.

When asked about the condition of the taillight before purchase, I responded:
"Very minor abrasions from normal wear, but nothing wrong with the tail lights." as every single photograph I've posted of them on RX8club shows. Not "broken" as he had claimed them to be.

Upon instruction from Paypal's dispute escalation department, the buyer, Riken in this case must show proof that he received the item in a condition other than described/photographed upon receipt.

Paypal has verified that I have fulfilled all obligations as the seller to be protected in this transaction, and has asked me to formally request in this forum that he return the aforementioned item via certified delivery in the same manner that it was sent out.

A copy of this post will be sent to Paypal disputes department as per their request.

No further transactions will take place between myself and Jose Chavez, RX8club member name Riken due to his actions, nor do I recommend anyone else sell anything to this person based on his actions.

If Riken wishes to resolve this matter, he has my email address and my phone number. Paypal's escalation department in the mean time will be contacting him to establish communication on the matter, and ask him to fulfill his obligations as a buyer using paypal's services. I will post the results of Riken's actions here in this thread regarding his efforts to prove his claim.

I will await to hear from him on the matter. I will be recording all phone conversations to and from him, and will notify him in each instance that the conversations are being recorded before each conversation begins. Each conversation will be furthermore submitted to Paypal as burden of proof.

It is entirely possible that the item was damaged en route to the buyer, in which case, a claim can be made to USPS for reimbursement or replacement, however, again the proof must be submitted to either myself, Paypal, or the US Postal Service.

Since this section is designated as this forum's buyer/seller dispute area, I request that Riken respond to the matter at hand. It's not the issue of the amount, as much as it is a matter of principal, and per Paypals buy/sell agreement according to Paypal resolutions department:

"If an item is shipped and received, payment agreed upon prior to shipping is due. If an item arrives in any condition other than described and/or photographed, the seller needs to be contacted before payment can be rescinded."

that sucks man, seriously. I had some ******* do the same thing to me with a PS3, just be happy paypal is acutally helping YOUR cause. People can be grimey.

I am waiting to hear back from Riken on the matter. In the mean time, Paypal's dispute resolutions department said they would contact Riken on the matter as to come to a resolution.

Riken made no attempt to contact me, and any person who has purchased anything from me, whether it be at this forum or any other, all of my contact information is always given. There is zero excuse why Riken has not as of this posting, made any attempt to contact me regarding this.

Dude your pics are of the front of the lights I wounder why you didnt take pics of the side where you connect the light bulbs. Well now I know. The lights are missing/broken off the part where you screw the light to the car/bolts. Yes great packing. Ill give you that. But you stated good condition. You meant broken=bad condition? Please refund me today!! Ill ship the light back to you today as soon as I get a refund.

i agree that it looks like rx8evo could easily have broken those tabs while pulling the light off the car. It happens a lot and he didnt take pics of the back of the light like most people would. Who wants four pics of it in bubble wrap and not one pic of the back?? Riken seems to be a decent guy to me. Its a worthless taillight without those tabs to bolt it up and if he was just trying to "fraudulently trying to keep your item" he wouldnt be offering to ship it back.

those tabs are fragile, I remember taking my tail lamps off last month and was shocked at how easily those can be broken if you don't remove the light carefully.

if evo has pics of the back of this light before he shipped, this could be easily resolved.

Good luck guys, I hope you're able to get your money back and ship the part back to Evo.

i already pointed this out in his FS thread. Im sure he didnt notice, but even after you took pics of how it was received he failed to pay attention to it.

seems to me (by his own pictures) that he accidentally sold you a broken part and overreacted by throwing up this thread. (in reaction to what he believed was an over-reaction on Riken's part)

Either that or he's a scammer, which I do not believe is the case.

yea i dont think he is a scammer, just a misunderstanding like most are. ive had my share of bad guy threads over stupid stuff that turn around on the other person anyway :P

yeah, I'm chalking this up to a misunderstanding considering evo photographed the back which showed the broken tabs. Might not have noticed they were missing.

As far as me "logging off" right after comments were posted, you can think what you will but I am at work right now and I cannot dedicate a lot of time online while at work, but it is in both our interests to work this out to a solution.

Again, my phone number is clear for all to see, yet still no phone call or email. Is sending a PM the ONLY way you can communicate on the matter? It's obvious that my inbox is full.. you don't have to keep PM'ing over and over to the same result.

I can't just start deleting PM's at will w/o reading them, and as I have already mentioned.. I'm at work, however, I will get to clearing out and responding to some of the PM's so that you can PM me, however, I can be reached by the other two methods.

Riken can either:

1. return the item as both Paypal and I have requested so that Paypal can credit your account, once it's proven that the damage claimed was as claimed (possible, however, I was not aware of any damage upon shipping item out)

2. keep the item, and upon confirmation that item was damaged prior to shipping, compensation to be given to repair aforementioned clips or equivalent.

3. send the item back for an exchange, again, AFTER it's been determined that the clips weren't broken by Riken upon installing the tail lamp. I'm not trying to say that it's impossible that I shipped the item the way he is describing, however, I do not remember any tabs broken off before shipping. Riken.. is it possible that you may have inadvertently broke tabs upon installation? Just a question, since I cannot physically see the unit any better than the pics you have posted.

If you had responded in a more amicable manner and described the exact issue, rather than just saying that they were broken, or even called/emailed me before trying to make me out to be a swindler, then this thread would have never been started.

So.. can you call or email me in the mean time until I can clear up my inbox? Thanks.

evo: not bustin' your ***** or anything but if you look at the picture in the F/S thread (which I believe was taken by you), you can notice that the clips are already broken. As I mentioned earlier, they're quite fragile. I almost broke one last month removing my lamps.

Option 2 looks like a good place for you guys to start. Hope it gets resolved soon

yea it is pretty obvious you sent the item broken. The burden should not be on riken, he is on the bad end of the deal here, not you.

"repairing" the item is simply not gonna be just as those are the critical mounting points and only way to replace them is with a new assymbly.

Only option i see is that you let paypal work out the refund for him first, then he sends it back.

Well then, it sounds pretty settled to me then. I've already contacted paypal, and the funds are in a hold status, so neither he nor I have the funds, until the taillight is returned, so Riken is at no risk of not receiving back what he paid.

I should have inspected the tabs more closely before sending out, and was not aware that they were broken, nor was it ever my intention of selling anything that doesn't work. My reaction was to his preemptive reaction upon receiving the taillights w/o contacting me or accurately describing what he meant by broken. Simply a misunderstanding it seems.

Once this has been settled, (as I'm sure it will be rather quickly at this point), please delete, move, or change the title of this thread to [resolved] as I do not wish Riken to be viewed as a bad guy/bad buyer, as it was a misunderstanding on both our parts.
