2/10/2008 -- Officially the worst day in an 8's life....

well 2/10/2008 will officially be the worst date ever...

so i was @ target in LI cause my gf n I needed to get some stuff and I wanted to see if i could find that low profile license plate bracket So anyway i park the car far from other cars and all loose shopping carts in the parking lot. I turn off my lights and about to turn off my ignition when all of a sudden the ******* shopping cart came out of no where doing at least 10 mph and slams into my passenger side rear suicide door. I thought a car crashed into me so I jump out about to **** someone up when i see it is a cart so i move it go back to the car observe the damage and look up and all of a sudden there are 6 MORE carts heading towards the car, from the front, the rear and both sides of the car so there is my gf and I racing around the car stopping more shopping carts from hitting my 8. i was so mad and my gf was just a furious that we went in to target, double parked by the entrance and requested to speak to the manager. jenn tells me to watch the car outside so no more carts hits the car and she goes ballistic on target...finally i go inside get the paper work needed filled it out, had target take pics and had them reassure me that it will be taken cared of. the manager explained to me the process so this week i will have to go to kenny (body shop) to get an estimate on the damage and have him do what he needs to so i can get some of my body kit work done as well on TARGETS funds. so the manager explained it is all dependant on the estimate if it is within a certain $ amount they can give me cash to fix if it is more it is through target insurance and they mail me a check to fix. im so upset i was so angry when i was filling out the paper work that i was jittery and couldn't focus to fill it our....was so angry and still upset.

Wait, your car isn't silver... Does not compute

I'm surprised Target is actually picking up the bill... Nice though.. When I went out yesterday I specifically parked between other cars to hide from the kamikaze carts...

Sorry to read about this.. What a nightmare! It's great the manager is willing to assist you. If I may suggest, take the store number down along with it's corporate address, make copies off all documentation just in case you run into any problems and you may need to escalate it. Hopefully, it won't get far and the manager will take care of everything.

his car is not silver....that is why he was only hit by one cart and not 40 of them......if it were silver there would be other cars rolling into him!

Damn...! Thats just wow. For a moment I thought you where gonna say "Then we see these punk *** kids laughing at us as they toss more carts our way."

Major props for the Manager not pulling the classic "We are not responsible for stolen or damaged vehicles in the parkinglot." line. Then again I'm sure your gf ripping him a new one helped alot with him not saying it, that and I have a feeling he knew that he should of had someone out there collecting up the carts. Last thing he probably needs are you two going over his head getting a hold of the Disctric/Area Manager and having them asking the Store Manager "How come no one was out there collecting the carts?".

Hope the damage is minor and doesnt require a brand new door.

no actually from the looks of it I doubt the door will have to be repalced...but it deff needs to be refinished and smoothed out.

im hoping to know whats going on by the end of the week. Should be speaking w/the rep I say latest by Wednesday (since I left him a voicemail today) and I'll be @ the bodyshop this aturday getting the estimate and letting them handle it directly w/Target for payment.

So if things run smoothly perhaps the car will be repair by next weekend the latest...

damn. sorry to hear about that. did the carts come loose from the return bin or did a target employee push them out not knowing u were there? what exactly happened?

UPDATE....

just spoke to the guy....apparently he informed me something semi negative but dont wanna think that way just yet....but he said they have something called general liablity for target

if it is determined that it was solely weather as a factor that it happened they will not pay me a single cent. Now if they determine that there was a cart attendee on site and that the parking lot was flooded w/carts then chances are I will get awarded.

I have to fax him my insurance info and the quote. I told him plain n simple i wont go any where i dont trust and that I got recomendation to a body shop that people trust so that is where I want to take my car. I told him I would have the hsop fax him the paper work on saturday so we can speed this process along quickly. I explained i jsut got the car and havent even made a car note yet and he sympathized w/me as he had the same exact situation happen to him so he totally understood where I was coming from.

He is going to call the Target location and start the investigation process so we can have this handled asap. But he cant totoally do anything until he receives the report from target w/the pictures and all my paper work. SO I am looking at my car being banged up anywhere form 2 weeks to a month....very upsetting....

Basically i specifically parked somewherre secluded away from allloose shopping carts and cars so I wouldnt get banged up....the entire parking lot was flooded w/shopping carts. My luck the wind blew them inmy direction.

In other words the cart attendee wasn't doing his/her job...

i have no pics of the lot i wasnt clear headed when it went down...i was in rage actually. very pissed that i didnt think of taking a pic of the kart ont he car, and pics of the lot itself...but i have pics of the damamged and my report and a witness thats it...

suggestion: go back EVERY night and take pics. If you can establish a pattern of the cart attendants not doing their job, you might have a strong case.

i would be willing to bet that target will say it was out of thier control because the attendee was doing his job but the weather conditions were for lots of wind and it was an act of god.....that way it becomes less of a responsibility of them.....

Always, I mean always adjust parking based on other vehicles and wind direction!
Believe it or not, I always park up wind for that very reason.
Also, when I see people just leaving a cart in the lot, I will call them out on it, the lazy @sses.
If I see one I will grab it and take it back in while I'm on the way in.

Well if they knew it was a windy day (today) then they should be held accountable for the carts in there lots that they did not recover. Most places put up signs saying they are not responsable for any damage made by carts. I would go around and see if they have sucj signs up.

your car is new, so i would suggest to just file a claim with your insurance and let the compressive coverage take care of the damage. and, let your insurance co. deal with target and try to get your deductible back. insurance claim agents are, after all, trained to do that sort of thing. plus, this way u don't have to wait to get your car fixed.

honestly, target's liability policy sounds very subjective. so, let's look at it from a a different angle. i'm by no means an attorney and can't offer any actual advice- only speculation pulling from my business law class from college years ago...

and, as i recall, an establishment cannot be held liable for conditions on their property that cause a loss or injury if they are not aware of the problem. this law was specifically authored to protect retailers against unscrupulous customers who walk down the soda isle, open a bottle of soda, spill it on the floor, "pretend" to trip on it, and then cry foul.

in other words, if someone told the store manager about the spill and the manager ignored it and then someone tripped and fell, then the store could be held 100% liable. but, the store wouldn't be liable if the soda spilled from someone knocking it over and no one reported it to the store in a timely fashion.

the shopping cart + wind in the parking lot is, of course, slightly a different scenario. but, the manner in which the law applies is generally the same.

if target (1) knew there were strong winds outside- ie weather conditions conducive to creating this type of damage (2) knew there were excessive numbers of carts outside and (3) knowingly failed to do something about it, then yes- they could be found liable under the law. however, this would be very difficult to prove, because wind conditions change all the time. one minute there's wind, the next minute no wind. and, when there's no wind, it's not unreasonable that this type of thing wouldn't occur.

i think that most likely what will happen is, it will come down to how much this particular target cares about its reputation. if the manager is smart, he'll just settle this and pay for the damages and make it go away before any negative publicity comes out. if he wants to be an *******, then let your insurance agent fight for you and get your $ back. worst case is u may have to take them to small claims to get your $500 deductible- of which the above conditions would have to be proven to a judge in order for you to win.

so, again, i say just file a comprehensive claim and get your car fixed. it really suxs, and we all empathize. it's happened to all of us at one point or another. **** happens. just don't let it bring u down.
