Juan,
What's your insurance coverage, and what policy do you have on personal injury?
Does the other guy have insurance? Make sure to tell your insurance company all about your injuries so they can provide any assistance in the meantime. Find a personal injury lawyer while that happens.

Thanks guys,
I got a lawyer -- we gonna take them to the cleaners.....The dude was driving for a cab company so we getting all of them.
I have full coverage insurance so im good -- my hospital stuff is all being paid for and they gave me Valium for the pain so im feeling awesome right now.
I spoke with the insurance company they said by the description i gave them its at a 75% loss and that most likely it will be a total loss since so much other stuff has to be replaced.
I didnt even count the airbag/dash fix, sensors, seatbelts....crazy

Well its ******* dumb cause this should all be taken care of by the other insurance company THIS IS NOT MY FAULT!
My insurance are being ********* with me right now -- they want to repair my car talking about everything can be fixed.....They just wanna save money if the repair is like $500-$1000 less than value of the car they going to want to repair it
Repair est are going to be WAY over the value of the car and no i don't have aftermarket clause but since this wasn't my fault the other party should be covering that ****!
Anyone know any good bodyshop that are expensive as hell and do great work? Insurance is trying to make me put the car is some junk bodyshop (one that cost less than a normal one but they prob do shitty work but it keeps their insurance cost down) -- **** that

I spoke with my friend, and he says the DMV placed a law into effect that prevents car repair shops from overcharging for repairs. The repair shops have to file all insurance claims through taxes now. You can try my friend's place though, I went there for my repairs earlier this year when I got my car into the accident. Do you have any estimate for the damage?

Check your insurance fine print. Usually, if the cost of damage is over 75% of the market value (go by KBB), you can opt to have it totaled.
*edit*
Is there a police report?

1. You can take YOUR car, for Repairs wherever YOU want. Don't let them tell you otherwise.
2. From my past experience, you go through your insurance, and they will sue the opposing guys insurance for the money.
3. Aftermarket will not be covered. In many cases the shop you work with will have no problem putting aftermarket on the car instead of OEM, and in many cases they profit more that way.
4. You can request multiple estimates, and use this as the basis for totaling your vehicle (Go with the highest estimate) if this is what you want.
Nonetheless, you feelin any better?

My lawyer said to go through my insurance company and the other insurance company will pay for everything when they conclude that he was at fault for running the stop sign.
So my insurance is being dicktards but im gonna fight with them and let them know they should be contacting the other party and not ******* with my car.
Right now im taking my car to:
Sports Car & Classic Ltd
519 E 73RD St, New York, NY
I have to pickup the police report tomorrow and it has all the other drives information along with his insurance information and my witnesses and reports so ill send that to my insurance aswell.
Repair cost without lifting the hood and checking for engine damage or frame damage is $7500(both headlights not included in that price) which isn't bad but then again this is a cheap hole in the wall bodyshop.
When i go to my own bodyshop its going to be way more cause i want the job done right....I dont want my car totaled but if its fucked up to the point where its not right then i dont want it.

You definitely should be going through your company - they tend to get pissed off if you sidestep them. Make sure to read the police report, if it places blame in any way (i.e. car B struck car A), that is the key to convincing the insurance company that the other car was at fault.
Can you post, or PM me your car info and the breakdown of the cost? Did you have HID's? If you did, those guys are a grand a piece, which can help to make a serious chunk.
Again, check your insurance policy booklet. Most insurance companies provide a "total" option, and they cannot force you to repair if you want to total. I don't know what your extent of damage is exactly, but it may or may not be able to be repaired to the original feel.
Now, after saying that, mine suffer some frame damage after I got in my accident. It got repaired extremely well, I can barely notice any difference before and after.
