Another Ridiculous Ticket
#51
this is just a cycle of never ending ****. from your local drive thru person that when you get to the window for your food you politely point out that they gave you the wrong food and then gives you an attitude like if you are the one that messed up instead of the person taking the order, to judges talking down to people in court when they are there to make a decision not ridicule you for your mistakes, to your politician that loves to stuff his pockets with tax payers money.
#53
Well in your case, yes, you didn't do anything wrong. It sounds like the cop was a geniune dick. Arguing doesn't help much, but yeah if you need to explain something then by all means, explain away. That guy is probably just a control-freak, had a bad day, and took it out on you. I would definitely take it to court and have it reversed. He enforces the law, but he is not the law itself. If you have papers that excludes you from a law, he should let it go.
#54
cause i can use that against him in court? i showed him proof of my exhaust being legal and he chose to ignore it and act like a dick first..so i CHOSE to argue with him to try to convince him that he was WRONG so that pissed me off..the point is that he was a dick face and he is going down
However, in your situation, if you gave me a paper that said it was under 95DB "as test" at the the BAR, I would not have issued you a ticket unless you talked your way into it. If you argue and act like you know more then the cop, thats a good way to get special treatment.
So why do I and other cops do this?
We dont get a kick out of driving around and issuing fix it tickets, we are looking for bigger and bader things. All my best cases came out of simple traffic stops for minor things. Now when I get a minor violatioin such as yours and I find nothing bigger, I may still write a ticket, for 1 of 2 reasons.
1: If the violation is so obvious, super loud exhaust or limo tent, I want to write it because you need it fixed otherwise you will keep getting pulled over by other cops and they will be wasting your time and there time.
2: If you talk your way into it. People need to learn respect. 75% of cops work there a** off and really do want to protect and serve. You might not understand what and why they do what they do, but its there job and you need to show respect.
None of this means that the cop is always right or that you cant ask questions or make statement, you just need to do it in a respectful way. If you cant seem to say the right thing, then keep your mouth shut and you will be doing yourself a favor.
What the OP needs to do now. Well if you exhaust tested anything above 85DB, well its too loud and no judge will ever let that go. The cars we here from a mile away or that wake people up in the middle of the night are 85+ DB.
However, if your exhaust is under 85DB, then go get the stock exhaust tested or find someone else with a stock RX8 and have it tested. Then go to court and show the judge that a stock rx8 is already a little loud and yours is not any worse, or only a little louder. But again, show respect. "your honor, I am really not trying to break the law. I bought this exhasut because I wanted to get better gas mileage and a little extra power for when I track my car. I thought it was legal becasue that is what Greddy said. I also had it tested and its under the 95DB and it is only (XX db) louder then stock."
Oh, and check greddy's website, most companies make no referance to an exhaust kit being sound legal, its only emmissions legal.

I feel for you, man... that sucks.
I used to have a roommate who was a Sheriff's Deputy... and likewise, a good friend is a PO. Imagine if you had to deal with idiotic acts (at best) all day... and potentially life-threatening situations at worst. It does wear away at them.
Be respectful, and that's all you can do. I rarely get pulled over. However, from my experience, most of the PO officiers were generally fair and understanding people. Once they see that you are not a threatening person, you'll usually get off with a warning. If they've identified something that you know you did wrong, admit your fault.
Then, there are simply times when the PO is simply hell-bent on writing a ticket, in a bad mood, had a bad day, or is simply a poor representation of a cop... during those instances, there's little you can do: you ARE going to get a ticket. My father had an Audi A6 when they first came out. He is a college professor who had never been pulled over. A cop pulled him over just to give him a ticket for "illegal headlights," even though they were stock. He even ended up on the evening news to argue his point, but of course, the PO/PD declined to comment. The judge threw it out, obviously.
When you get pulled over...
1) Find a safe place to pull over.
2) Turn off your music, roll down your windows (esp if tinted), put your hands on the steering wheel where it's visable, and sit & wait.
3) If it's night time, turn on your interior lights. This allows the PO to see exactly what you are doing... which reflects their safety.
4) Don't fumble around for registration, ins, wallet, etc til you are asked... b/c I'd be nervous walking up to a car where the guy appears to be shifting around, reaching into glove box, back pocket, etc... just sit and wait.

i understand your point highway8, he acted like an ******* first from the very start when he came to my window..so that got me really irritated..probably the worst behavior i have ever encountered with a police officer..but yeah, thanks for the info
#57
Again, I don't think that whole 'never give out info' thing really works. The cop knows what you did wrong, and he knows that you know what you did wrong. Pleading ignorance doesn't change anything, nor does acting like an oblivious idiot. Just come out and say it. You know what you did was wrong and you're sorry and its not going to happen again. In my mind it shows more respect to the cop and you're more likely to get off with a warning.
#58
Oh, when it comes to admitting things to the officer, dont volunteer any extra info. When they ask, "do you know why I stopped you?" dont admit anything instead say "I am sorry but I really dont know". However, when they ask, do you have any "modifications under the hood, or any emissions modification?" you need to tell them them, "yes I have X, Y and Z but they are all street legal" Because if you tell him nothing it might **** him off when he finds you have X, Y and Z. If your mods are not street legal, stick with the story that they are. If he asks where the stickers are, just tell him that you never saw the sticker or it came off when you washed the car or you had a shop install the parts but you were told it was carb legal. He can still send you to the referee but he might not, its up to him.
Hope that helps.

You guys must remember, The United States Of America Has the best GOVERNMENT in the world. They tell you everything about what's going on in the world and it's not even biased, they always get the other side of the story before they take any action...
Glad I live in Canada, Cali really does have stupid a contradicting laws. Highway8, the laws you posted contradict each other, it's just useless info on the exhaust. If these laws were actually used by every cop, there would be no such thing as aftermarket parts that you can get from retailers or at mod garages. I think most of them are full of bs in order for a cop to get money.

The laws dont controduct each other, 27150 says the exhaust cant be loud or unusual and 27151 says it must conform to 27150 and not be over 95DB. Vehicles can still be modified and stay legal, there is a lot of things that can be done. How are exhaust noise laws stupid? I dont know about anyone else but I dont want 100+ DB exhaust going up and down my street in the middle of the night, waking me up and setting off car alarms.
Do the police in canada get money from writing tickets? In California the cops and the police departments get nothing from the tickets. The cities (most), counties (some) and state (very little on some tickets) get all the money. And with fix it tickets there is only a processing fee, no fine as long as the vehicle is fixed.

actually canada's health care system is far superior to our own. they do more and spend far less. i took a class that focused specifically on the u.s. health care system for my minor (sociology) and i was just downright disappointed.
we can rag on them for other things, like no decent car designs or any car manufacturers, but we mostly fail there too.
canada is one of those countries that is just, a cup of alright. there is really not much wrong with them.
besides that ******* cold.
oh, and i had an undercover cop race me (ON A TRACK OF COURSE) when i had my exhaust disconnected from my cat. cat was just straight dumping out. it was very loud. he put on his sirens, and then sped away. haha.

If you have the cash, fight the ticket in court. If you get an unbiased judge, you may win. The problem with winning is the cop will have a hard-on for you if he remembers your car.
In my experiences 7 out of 10 cops are dicks. I have a few friends that are cops and they feel the same way (they say most, I say 70% . Riding a bike I get singled out often. I've been pulled over for speeding even though I was being passed by vehicles in the right hand lane (I was in the middle lane). Yes, I was doing 75 in a 70, but the average speed is 78~80.
If the cop is a dick, you're going to get a ticket, period.

The reason USA health coverage is so expensive is because of all the lawyers. If there was a $$ cap put on malpractice lawsuits the insurance rates would go way down and the cost of coverage would also go way down. The other big problem is that a lot of people dont pay anything for medical treatment so everyone else has to pick up the slack. Lastly is the drug companies, they charge americans 10 times as much as everyone else, its lawsuits, lawyers and the strict testing required to get a drug approved (high R&D cost).
The good part about the USA helath system is that you can get good insurance and good health care.
The canadian system is a socialist health care system (words right of a canadians mouth). Everyone has the same coverage and gets the same treatment. They also let anyone and there whole family into canada and give them health coverage. So what you end up with is very full hospitals and very poor service. Think of Mcdonalds giving away free food. Sure you get to eat for free but you have to stand in a crowded line for hours and the food is not very good.
It is very common for Sick Canadians to come to the states to get medical care, but they go back to get there drugs.
My experiance with the cops I work with is that 7 out of 10 are cool, and 3 of 10 are on the rude side. But 7 out of 10 can turn into a dick real fast when people ask for it.

We are the only developed country without socialized health care. IMO, I think our taxes should pay for healthcare for everyone.
Instead, greed controls our healthcare... there's nothing democratic about it. Insurance companies and pharm run our healthcare system. And yes, atty's. I used to own a medical management company.. dealing with insurance companies is just nasty. Likewise, there're more than a few board members of pharm companies who used to be our legislators... and who passed laws favoring the very industry that now pay them millions. Conflict of interest... you think? Our medical, ins, and pharm industry is one clusterphuk.
my recomendation ....
the trick to not getting pulled over is not to bring attention to yourself. diffrent color rims, spoilers, rims, special paint jobs, dark tints, lights, ***** hanging from a hitch and such will get you pulled over for sure. i know it sucks because i went through it when i bought my first vehicle.
..........teach them that they dont have to be dicks with people to get their point across specially when they themselves have comitted the same mistakes prior to being a cop.
Thank you^^^^
*Some of our RX8s are metallics (people ask me where i got my paintjob sometimes)
* I have the lightest on my driver and pass windows, and for the first time last week in 4 years and outtta being pulled over like 10 times i got a TINT TICKET. We do live in California when in Summer its gets to like 90-120 degrees i mean Cmon now.
*HIDs/halogen lights i have not had any officer say anything and i run 10K.
*Exhuast, well Racing Beat did Dynos of their catback and others and 3.5hp for $600+ was not for me. So what i just did was cut my old tips and put 4" tips, no different sound than stock exhaust, all i wanted was the looks i did not want to attract anymore attention to my car than it already does. I would laugh if a stupid cop was to give me a ticket for an aftermarket exhuast just because my tips look bigger. LOL. I would laugh in court.

You must have pretty bad luck in your police encounters. Almost every cop who's stopped me has been courteous and professional. A couple of times there wasn't much courtesy, but I got the feeling something was going on that I didn't have a clue about. Never ran into one who was a dick, never got a ticket that wasn't clean.

From time to time I get bullshit tickets just like yours
Guess what, I got one about 3 weeks ago. I was so pissed off I was about to put my car into reverse and ... I didnt talk about it at all cuz Im in process of fighting it so yeah ... not gonna talk about it till its done.
Im not sure about any other parts of the country but in NYC, they WRITE TICKETS FOR A LIVING. sure the tickets wont directly go into the police department, but one way or another its still going into it. Not to mention, our great fuxking mayor hired thousands of "extra" people just to write tickets. its a huge cash cow. of course the result is a lot of "bs" tickets when you did nothing wrong. He wants to be elected for 3rd term ? he must be smoking.
For me, 9 out of 10 cops that I've encountered are dicks. most have nothing to do they just gonna camp at stop signs to wait for people to come ...
