Thats from the bumper 2 bumper warranty but its the same for the others.
Did you only have receipts for 5 gallons of oil? That would probably only do about 4 total oil changes with some left over. I know when I change mine I usually only get about 1 gallon of oil out. You told them you did 5 oil changes, which might be possible but over a 3 year period that 5 gallon jug probably wouldnt even be enough to top off your oil between changes lol.
If you only have receipts for the 5 gallon jug of oil then I think your screwed. By getting a lawyer you might just be digging your hole deeper.

Correct on the claim... Receipt of material are the only prove anyone that does self work will have unless is video taped like 9krpm said... One thing I have on my favor if they try to claim I not certified to do it is my uncle is an aircraft craft mechanic

Also the person who said they recommend every 7,500 miles is right, in the manual it says to change every 5k if any of the following apply:
l Repeated short-distance driving
l Driving in dusty conditions
l Driving with extended use of brakes
l Driving in areas where salt or other corrosive materials are being used
l Driving on rough or muddy roads
l Extended periods of idling or low-speed operation
l Driving for long periods in cold temperatures or extremely humid climates
l Driving in extremely hot conditions
l Driving in mountainous conditions continually

So you have the receipt for the 5 gal jug + filters and then you have receipts where the dealer did oil changes between yours every now and then, right?

otherwise change every 7500. So if you changed it every 3k and (hopefully) wrote the mileage and date of each change down somewhere then you should have a good argument. Even without writing it down it seems like you should still have a chance I guess if you can somehow prove it.

I think you and your attorney are going to have to take this to court. It could be small claims or district court, depending on the value of the claim you're bringing...most likely the value you're going to seek will be above the small claims level. Once in court you show your written log of oil changes and receipts for the materials, I think you'd get a favorable judgement. You can also recover court costs and attorney fees and possibly consequential damages related to the rental etc.

Well at least they extended the warranty here in the U.S. , I think all the people in the other markets really got screwed. Thank god I bought an extended warranty on this car in addition to the Mazda one.

they don't give a crap about publicity. if they think it will go to trial they will try to settle to cut their losses. If someone bothering to take them to court there's a good chance they will beat mazda, especially in small claims where the bar is quite low. The will settle upon being served, or right before the trial. it would cost them nearly as much to prepare and send a rep or lawyer to a trial as it would to cover the engine. I highly doubt they'd take it into court unless they knew for sure they would win because the owner previously had done or said something that was on record with them.

After that the owner have to pay for it himself.
think about it, if your engine go out after 1,5 year you have to pay for it.
You need to be a real entusiast buying an rotary in Europe. =( specially as the car costs $57 163,53 and one tank of fuel $120 in Sweden.
BTW Im thinking of buying an second rx-8 as DD here, I must be out of my mind. ;-)

I was in this situation. Had a car spin a rod bearing while under an extended warranty. I do my own oil changes and had no reciepts. My wife hoever, took hers to get it done on occasion(I wasnt touching that ford more than I had too!). I ended up altering her reciepts with MSpaint(yea really) to make the ones I needed for my warranty.

I got my engine replaced under warranty in June. I wasn't asked to produce one single receipt. I, however, did have all maintenance records from the time at which I took ownership of the car. As others have stated its your responsibility to keep all records of maintenance. If I was you I would travel to another dealer and give them a shot. Unfortunatley all dealers don't follow the same protocol when honoring warranties. It almost appears that Mazda USA leaves it up to the dealer to decide whether to submit a claim to Mazda USA or not. I don't quite understand why a dealer would turn you away when you have all your records. Its not like they do the work for free. The dealer is getting paid for the warranty work by Mazda USA.

Nobody ask me for receipts.
Either :
- They know Im a freak, talk mad crap about how much oil I changed every 5 weeks and stuff, they know who am I, so never bothered.
- I was still under bumper to bumper warranty (42K miles when it failed)
- I entered all oil change record online into their system.
I have a whole box of receipt in my basement, anytime they need it.
