Have you checked on the prices of new 2005 cars. The 2006 version will be comming out soon and I hear they are giving Big discounts.

Hey,

I just did a carfax on this RX-8 for you. It didn't come back good, it doesn't qualify for the carfax buyback guarantee because of a manufacturer buyback reported buy a DMV.

It also has only 19 months remaining on the warranty because it's an early model 2004. I just bought a late model 2004 RX-8 with 34 months remaining on the warranty.

I got mine with the Sport and Touring packages for $20,000 even (two weeks ago), and it only had 2,200 miles on it. I also saw the same car advertised for $18,995 with 22,000 miles on it.

Even if this car wasn't a lemon, you shouldn't be paying more than $19,000. If I were you, I'd look for a late model 2004 with more months remaining on the warranty.

Here's the carfax report:

ALERT! Severe problems (major accidents, fire, flood damage, major odometer problems or lemon history) were reported by a Department of Motor Vehicles (DMV) for this 2004 MAZDA RX8 (JM1FE17N940105032). This vehicle does NOT qualify for the CARFAX Buyback Guarantee.

The story of this 2004 MAZDA RX8 (JM1FE17N940105032) according to our interpretation of the information reported to CARFAX:
Blue Arrow This coupe has had 2 owners and was owned in Texas. It was originally registered by the owner for personal use.
Blue Arrow It has had no minor or moderate accidents reported to CARFAX.
Blue Arrow It has had no DMV-reported total loss events, like a major accident, fire or flood.
Blue Arrow It has not been reported by a DMV as having an Exceeds Mechanical Limits or Not Actual Mileage title.
Blue Arrow It has a consistent mileage history with no indication of an odometer rollback. It was driven an average of 12,045 miles per year, which is lower than the industry average of 15,000. The last odometer reading, reported on 12/22/2005, was 28,819 miles.
Blue Arrow It was repurchased by the manufacturer after repeated repairs. It was reported by a Texas DMV or state agency as a Manufacturer Buyback or LEMON.
Blue Arrow It has no recalls that still require repair.
Blue Arrow CARFAX estimates it has 19 months or 21,181 miles remaining on the basic warranty. The basic warranty provides bumper-to-bumper coverage.

FWIW, I don't think its likely that the car he describes was a buy back due to the horse-power issues. I bought one of the cars from that issue and the Carfax was very clear. It used wording to the following effect.
-Manufacturer buy back due to Horsepower Advertising settlement. There are no reliability or maintenance issues associated with this buyback.
That's pretty different wording between his Carfax and mine and in addition mine WAS Carfax certified. I would be more concerned that the car was one of the early '04s that was lemoned due to multiple flooding incidents.
