For a long time now my car has had trouble shifting from 3rd to 4th at high revs. Not exactly the redline, but usually around 70 or so. It just won't go into the gate.

I asked about it on this forum but no one replied to two different threads so I brought it into the dealership.

I waited for an hour or so and than they came out and said that they weren't going to fix the problem because it occurs over the speed limit and their warranty doesn't cover "hard driving".

So by this logic...if my car dies at 56 miles per hour, they are not required to fix the issue.

What do I do, I'm sick of dealing with this stupid scumbag dealership. They're just being *********** to me because I'm one of the ones that knows my car doesn't have pistons and the minute any customer seems to know what their talking about they're marked with the "make life as difficult as humanly possible for me" badge on their computers.

Hmmmm, I've had the same issue but it was do to a fluid change. I had royal purple and change to redline which solved the problem, but I am still worried that I'll eventually have the issue you are dealing with now.

I also noticed that it occured during cold weather instead of hot summer.

and where the hell does the warranty booklet said they wont cover problems over speed limit ? If the car cannot do 70 mph, might as well just get a KIA RIO, Cuz Im sure even a RIO can do 70 mph.

There simply aren't any other dealerships within any reasonable striking range.

Their justification was that for them to fix the problem they had to replicate it and they would "not break the law to do so".

In NYS, I think the highest might be 65mph in the upstate areas. That's dumb though. There are higher speed limits all over the country, how can they not fix a speed issue if you could easily be legally having this problem on a different road in the same country. Heard Route 66 has no speed limit or something, and Nevada or something also.

How does a legal speed limit have anything to do with the car's warranty? They aren't related. By their logic, if you go 45 in a 35 speed limit, and something breaks, they wouldn't cover it...

Sorry. If they won't cover it, contact your state Attorney General and lay down the hammer...

Stop telling the dealerships that you're doing 70mph when this happens. Just tell them it happens. If they can't replicate the problem, then offer to take the tech out with you and show him. They wont "break the law" but that doesn't mean you cannot in order to replicate the problem.

You're simply enabling the dealers to cast redtape all over you. Vaguerities are always the best way to start off when dealing with the dealership.

My example: when i bought my car, i questioned whether or not they checked the coils, plugs, etc. They said nope, not part of the 30k inspection which they do on their vehicles before selling them. Well... gee. Reading these forums enough i have come to learn that the coils should be inspected around 25k or so. a month later i called the dealership and told them the car was stalling at stops for no reason. Did it actually? no. Is this a symptom of a failing coil? yep. So that's what i told them. The car never had an issue though but i wasn't happy knowing that the coils might not be on the up-n-up anyway. So i took the car in, left it with them for a day. Guess what? One coil actually was bad. Four new coils please mr mazda tech. thanks! have a great day.

Moral of the story: screw morals... do what needs to be done to get accomplished what you want when it comes to dealing with any kind of warranty issue be it car, electronics, etc. Companies will 9 times out of 10 try to do the absolute most bare minimum each and every single time. It's your choice ultimately on whether you let them or not.

Its Chicago Limit is 45mph outside the interstate, which is MILES away from the dealership....

Do what I did when my dealership was giving me problems, call MazdaUSA, complain that the dealership are being total ******** to you and you're heavily pissed off with the way you're being treated.

They are full of it, local traffic laws have nothing to do with the warranty, ask them to show you were it states that. Tell the dealer that you would like to use their phone to call MAZDA so that they can verify his explanation with him present. If they don't let you use their phone, use your cell. You'll see how quick they change their tone.

Its over...I got a call from them.

They're not fixing anything. They won't fix the engine which is now 50whp down on power because it feels fine to them.

They wont fix the transmission pulsating and not going into gear because they say that's normal. The issue is as blatant as if I brought in the car with a missing wheel.

The engine and transmission are dying and I can't do jack about it because I'm a minor and the dealer saying "Everything is fine" is enough to convince my parents that everything is, in fact, fine. They won't help fix it. I don't have the money to fix it myself. Their logic is that "just because it's not up to YOUR standards doesn't mean somethings wrong."

Thats it, I give.

I'm going to pick it up now and I'm going to trade it in so I can stop losing so much of MY god damn money on it. I don't want it any more. I can't do jack **** by myself.

I could bring them in a thousand dynos and they'd just say that because the test was independent they can't verify its accuracy. I don't want this car anymore. It's impossible to get it fixed. I just don't have any money left.

Its horrible having parents that don't know about cars. I could bring it into the dealership on fire. They'd walk up to my parents and say "its normal" and my parents would say "duhhuuhhhh OKAY :D we thought something might be wrong

Take your car to a reputable shop. Get documentation that something is truly wrong with the car from a certified mechanic. Take car to dealership, get documentation that they refuse to fix it. Call MazdaUSA and complain. If that gets you no where go find a lawyer and pay ~$100 to get a letter mailed to the dealership. There is a good chance the dealership will fix the problem then. They have a high probability of losing any civil suit even if they are totally in the right(at least in Texas). They will eat it only because its probably cheaper than winning a civil case, much less losing.

This will only work if your name is on the title somewhere. If its completely in your parents name and your state gives no legal power to minors you will have to take it up with your parents.

You're going to let the dealership bully you like that? What about other people later in life, going to let them do it too?

It's a toll free number, they're really friendly and helpful. Explain the situation to the rep kindly, give as much info as possible (make sure to have your VIN with you, they'll ask for it). MazdaUSA will take care of the rest afterwards.

MazdaUSA is on the phone with the dealership right now, I've tried to make it clear to them that the technicians *** is not as accurate as a dyno.

Im on hold...waiting for the guy from MAZDA USA to pick back up.

Just be calm and nice to them. Nobody wants to deal with an irate person, and things usually get done faster if you're kind and polite. Things will work out.

I've played the "I'm very calm because I'm at my wits end" card.

I told them "please don't make it seem like I'm vehemently complaining" when they call the dealership, I don't want to stir up a hornets nest, especially considering it's the only remotely convenient dealership from my house.
