I had this issue with hard starts at morning since 40K but they only confirmed that it is starter now at 50+K so they want me to pay

You could try.
First, find your copy of the repair order that showed your original complaint (with date and mileage).
Hopefully, they wrote down your good description of the problem...
Note on your copy where it says something like: "could not fault".
Next, go back to the dealership with the RO, and show it to the Service Manager - not the writer.
Politely tell him / her that you have brought the car in for this same problem before, prior to expiration of the warranty, and it therefore should be covered.
Keep notes of what the Service Mgr. says.
If you are unhappy with the explanation, call MNAO - the Customer Assistance number is: 1-800-222-5500
EDIT: Note - in my Canadian Warranty booklet, the starter is NOT COVERED under the 'powertrain' - it is only covered for the 36 month / 80,000 km New Vehicle Warranty.

they should of replaced my starter while it was under warranty (my VIN is below specified number)

Remember that a TSB is not a Recall.
A TSB is like a memo from Mazda to dealership techs outlining more-common situations, and the approved (for getting the dealer's time paid by Mazda IF under warranty) procedures for remedying the concern.
TSB's neither create warranty nor extend warranty, and are only to be performed on vehicles exhibiting the specific complaint.
Remember that a TSB is not a Recall.
