I had a similar situation happen to me and they fixed the car 9k in damages 6 months later the steering failed on my car and they had to get the part replaced after getting in thier azzez about the damage , they dropped the car at mazda and finally mazda said the steering motor failed due to the accident exactly 12 months later the new steering motor locked up and I called the dealer on it. The dealer informed me that they used a non OEM replacement part and the warranty on that was on a year. Any suggestions on what I should do?

Give them a hard time....you see where your fender doesnt line up with the door correctly? Its possible you have frame damage. Alot of times insurance will give a car a total loss for these kinds of damage. Make sure they either buy you another car or fix it correctly. Take it to your own shop and get an estimate to get that car 100% and get yourself a lawyer. and I take it you didnt have any bodily harm right? small scars are a reason to sue, make sure you're feeling allright.

Even a factory Mazda part only carries a 12 month warranty I believe.

your first and foremost mistake was letting the insurance company take it to their body shop.
Never ever do that!
They give you ebay parts and always mismatch paint. And they never get the job done right.
You have them bring the adjuster to your body shop[ and have your trusted guy tell them what needs to get done.

The autobody shop that i took it to was Sterling Autobody. Plano, tx
What type of lawyer should i seek out??
I actually received a call from the DA's office this week inquiring if i had put any monies out for any of the repairs, because they can go after the drunk driver for money that i put out.

Which part were you talking about where it doesnt line up?
Who should I contact, or have check to see if there is frame damage?
Was that impact enough in your opinon to cause frame damage?

Were you injured in the accident? If so, I would contact a personal injury attorney. He or she will be able to help you with your property damage claim and your personal injury claim. If you weren't injured, it will be a bit more difficult. Most attorneys don't want to handle a property damage only claim because there's not a lot of money in it. It's also not a great deal on your end because it takes away from what you can get. In other words - your car was damaged and that damage has a set amount; there's no "pain and suffering" component to property damage. Whatever that amount is ($3,000 or $5,000 or whatever) is really the most you're going to get from the other driver's insurance company. An attorney will likely not be able to get you any more money than you can get yourself. With that in mind, hiring an attorney for a property damage only claim isn't necessarily to your advantage.
All of this assumes, however, that you're able to stand strong and negotiate well. If you're a negotiating wuss - and don't worry, many people are - then it could be to your advantage to hire an attorney to do it. It may also be to your advantage to hire the attorney on an hourly basis vs. a contingency (33% usually) basis. If an attorney charges you $150/hour and it takes him 5 hours to negotiate a settlement of $6,000, then you're going to pay him $750. If he charges you 33% that same work will cost you $2,000.
