I've sued Mazda three times, once because they were denying a warranty due to insufficient maintenance records.

They settled 2 and lost 1.

8K or 15K miles.? - When dealing with any company on warenty matters you should be consistant.

MazdaUSA or MazdaCanada? - Why should Mazda Canada care about a car you bought and imported yourself? They got no money from you. Would you expect them to fix your Honda?

Well, you need proof (as stated multiple times before). It is not Mazdas fault for requiring records in order for you to be qualified for their warranty work. I would do the same as Mazda and reject anyone who doesnt provide proper records as noted. You are lucky Mazda is willing to replace your engine.

None of the Dealers in the US are allowed to open the engine up. Simply because most of them have ZERO ideas of how to fix/rebuild/put it back together a Rotary engine. and it takes too much time to train them all(more like too much$$$)

so that's just pure bullshit (about the tear it down to see if it was well lubricated)

well, now they give ya another engine, that's good news. enjoy.

Mazda's maintenance specs say 7.5k mile oil changes are ok, and they're right.

What the specs don't say is that the coils will die and take your engine with it.

It's the lack of spark not the oil that's behind engine deaths.

What? Can someone who speaks English translate this?

I told you I sued them multiple times. What could they sue me for?

Twice the settled before trial, one of those was on the day of.

The time they actually fought it, they showed up for court and lost. They ended up paying me substantially more than my claim was for by the time they were done.

Good on you, Ryan. Batting 100%. Did you use small claims court?

Personally, I think more of us should do this. As soon as you get an unjust warranty work denial verbalized to you - that's what small claims is for. Let the judge decide instead of letting Mazda make you jump through hoops and listen to more dealer level lies.

Maybe if more of us did this, it could force the corporation and dealers to work in a more fair way when our issues arise. The limit for small claims is anywhere from 5k to 10k depending on the state, from what I understand.

it wouldnbt be for the regular warranty but this is a specific extended warranty for specific faults. I think they are allowed to require records etc in this circumstance as long as the requirements are clearly written out. they could even require the maintenance be done for the extended warranty period be at a mazda dealer but then i think they'd have to provide it for free.

That is one way small claims can work to your advantage. It's informal rather than proper contract law - so in my opinion it's worth a shot and your much more likely to get a judge sympathetic to your situation of having a car with a dead, warrantied engine and willing to believe you performed your own oil changes. If anything, paying the filing fee is a great way to show any corporation that your serious - and going by Ryan's experience could give you 2/3 odds of reaching a settlement.
