It's a long story but the short and simple is that he purchased a Tribute for his wife around the same time he purchased his 8. He wanted the towing package for the Tribute which meant that it needed an oil cooler. The dealership agreed to put one in for him and represented it as Mazda parts. It turns out that the oil cooler was aftermarket and while his wife was driving it last weekend one of the hoses came off, drained the engine of oil, and toasted the engine all at once. Left her sitting on the side of the road.

Car is covered under warranty, he even purchased an extended warranty, but the dealership is saying that the manufacturer's warranty for the part is one year so they aren't covering it. Mazda is refusing to cover it since it was an aftermarket part. The dealership isn't covering it since they claim that his wife must've driven it too far after the oil light came on. So he is left holding the bag. I know some good attorneys here in town so I'm putting him in contact with them. The incident happened while my wife and I were over for strawberry daqaris and cards.

Thanks all for the help--much appreciated.
The dealer assured me the dealer installed tow package was fully covered under factory warranty which was the deal maker/ breaker and installed prior to my possession. I wanted to order from factory what I wanted but they wanted to move one already on the lot. The frickin' 80.00 Schucks oil cooler they bullshitted me with had only 12 month warranty and was installed 15 months ago. It leaked 3 times prior and fixed at dealer.
Mazda warranty says they are not responsible for after market parts.
The extended warranty 5yr/100,000 says it doesn't cover hoses or rubber parts--the hose clamp they installed fell off the bottom hose of the oil cooler ($1400.00 extra I paid for that little beauty)
Wife got oil light then engine light then complete loss of power before she could even pull safely off the highway.

Anyway zoom44 you can close this thread if you like -I know it is for RX-8 (which I also own) I'm just a little bewildered and distraught at the moment and wanted to vent.

when did they last fix the leak? you said it was fixed 3 times before in the last 15 months?

I gave him a good lawyer friend of mine to find the best attorney for his situation. My uncle Danny sits on the Board of Regents at Gonzaga Law so he is in good hands. I will also be calling the dealership up to let them know that me and several other people are watching the outcome of this transaction very closely. I think with a little community preasure and the right attorney he will be taken care of...

Last time they fixed the leak was 13 months ago.
Instead of using the mazda set up with brass lines and compression fittings they went to discount auto parts store and bought a cheap universal oil cooler and jimmy rigged it with rubber hose and a hose clamp.
They knew full well this couldn't be covered under factory warranty even though 2 different people assured it was to make the sale.
The GM at the dealership is still trying to go after the Regional district rep from Schuck;s auto supply--seems like a pretty desperet (sp?) act claiming faulty part.
The reality is a properly installed hose clamp shouldn't fall off a year later and the dealer is fully exposed on this whole mess they just haven't come clean yet.
I went to another local Mazda dealership who will put a new long block in with factory tow package for $4200.00 providing the core is still good (core trade in value 1000.00) That's 3000 for the block and 1000 installation and take about a week. Of course all out of pocket and me disputing (legal) afterwards. 3yr unlimited mile warranty
Man I'm getting pissed off again just typing this--I'm warranted out the *** just to protect myself from this very situation--aholes are gonna pay me now or pay me later--this is a slam dunk!

first they misrepresented what they were doing. then they did bad work that caused a failure. you didnt get what you paid for and it broke because of poor workmanship. sounds like a slam dunk to me. anyone you want me to send an email to? ill be glad to send one off to the dealership if you think it would help. you should try calling truoble shooter Tom Martino

cool website Zoom-I was not familiar with that--much appreciated.

I may consider lobbying your support If I exhaust all options--I am waiting for them to either say " since you are such a valued customer Gary we are going to make this right" (save face diversionary tactic) or "we're sorry Gary but we have exhausted all available options and you are on your own" (see if I am serious about pursuing them). Until I hear one of these 2 answers I have to sit tight and watch it unfold or they will say I didn't give them enough time and try to weasel out.
On a positive--the sun was out and the 8 was washed and met up with 3 other local 8's for lunch and quick run down the local drag--I was in my happy place for couple hours.
