Need Your Advice, Sketchy Dealer

I am currently dealing with Menlo Mazda dealership in CA. I got my 2004 used car from them in March of this year. Lots of problems/frustrations with these guys.

The car was not a "Mazda Certified Used" car, they wouldn't allow that for some reason.

They "lost" the spare key, leaving me with only one key. Nor would they pay for another key's programming, or do anything to compensate.

In March they said I would get my license plates within 90 days.

It's July now, no plates...nothing. My dad called.

Aparently the manager of the place fessed up. He admitted to "lying" to my dad. Menlo Mazda never had the title for my car. They bought it at some auction in Florida. At the time of sale, the dealership figured that they would acquire the title and the license plates within those 90 days, basically, they thought they could make everything cool before we would start to wonder and bitch.

So now I know why my plates haven't come in, why there are no spare keys, why the history report they gave us sucks, and why it says "Car noted as WHITE" for the year 2004, but "Car noted as BLACK" for 2005.

There is so much bull going on, I can't believe this. My dad said we could suit if they can't get the title. WTF, how could a dealership do this? I feel like I'm driving a stolen car now, or something. No wonder another Mazda dealership I went to thought my name was Jerry...(its not).

I really want to do something about this. Is it sensible to demand an exchange for a new car? Or to refund it? Or demand the official Mazda extended warranty? Or free service? Anything? I must get soemthing out of this deciet. Please help me figure out a plan of action before I call MNAO with nothing but impulsive bitching and whining.

Ask a lawyer. Sounds like a place you don't want to go back to, tho I'd be shocked if this place was the only dealership pulling such stunts.

Overall, you bought the car you're driving. You should have done a carfax and checked out the title especially considering the "sketchy" bs you got b4 even buying. There's no way in hell it's 'sensible' to demand a new car, but you may be able to get out of the deal w/it.

I'm no law-dog, but I'd guess it's illegal for them to sell the car w/o the title. They bought it at auction and prlly had issues b/c "Jerry" had the car repo'd from his sorry *** and the dealership was battling the BS to get the title.

The same thing happened to my sister when she bought her Suzuki. There was sketchy business going on with the dealer. In the end there was a huge lawsuit b/w a few buyers and the dealer. The dealer went to jail and my sister finally got her title 1 year after purchase. I would definitely consult with an attorney at this point, and notify MNAO you may be one of many they have screwed.

Before you get a personal attorney, call the office of your local states attorney and see if they will straighten it out for you. If they can't help, get your own lawyer. With the Black/White color and 2004/2005 details, there may be a case of fraud.

Call the Better Business Bureau--let them know about this place, and get in touch with an attorney!

any dealer that would lie to you like that deserves a law suit!!! don't take their bullsh!t anymore. I say you contact a lawyer and have them get you a new car or at least compensate!

They sold you a car they do not own.
They would have the paperwork if they owned it.
It may have been stolen and repainted.
If they cannot produce the paperwork they need to refund the full and entire amount.
I would take that money and go to a reputable dealership
Also alert Mazda central - and give Vin to Florida police - explain what happened it may help get papers (I doubt it) but it might stop theft of expensive vehicles!

Call the State Attorneys office. They sold you a car they didn't have clear title to.
IMO...........it's now gone far beyond just getting your money back and going elsewhere(and I'm the last person on Earth that would sue someone), but this is a pure case of fraud. The ONLY thing I would now except from this dealership is a brand new 2007 MT with GT package to keep them out of court! Then I would make sure I never got it serviced there.
