^I'm with you on that one bro. I really hate that you've had to go through all those problems. Everytime I took my car in for service the first thing they would scream is it has something to do with my intake. It got to the point that when they called me to explain the problem, I would have to head them off at the pass and say not to blame it on the intake. They ALWAYS had something to say about it. I got tired of hearing their crap so I just took it off. From then on, they never had anything else to say. I was waiting on them to try and say something about my cat-back exhaust but they never did. Hard to blame a problem on that.

Sorry you're having trouble, and I hate to side with the dealer, but personally I would NEVER mechanically modify any car while it's under warranty. That just's begging the dealer to deny warranty work.
I did extensive mods to my '91 Miata while it was still under warranty and had no mechanical problems, but... had a dealer denied warranty work, I wouldn't have been surprised. I mean, if I'm a car manufacturer, how do I know whether or not stuff you've done under the hood has compromised the engine? And why should I, as the manufacturer, have to do extra work to determine if your mod is the cause of the problem?
Again, sorry the dealer is giving you trouble. But on any new car - and especially one that's mechanically unusual, like the 8, I just wouldn't do mods until after the warranty expires. Or go ahead and do them but be prepared to be denied. Nevertheless, good luck!

I passed my warranty 10k miles ago on my RX-8 so I am modding away now!

I know the intake is a easy install but since i work at a mazda dealership I had a work order done so if mazda gives me any of this crap, it would look like a mazda tech put the part on. That should at least help a little right?

sorry to hear that -- i dont know the specifics of your engine failing but I had an apex seal blow and my car is modded, intake, exhaust, high flow cat, lightweight flywheel, pullies, clutch...
I had the engine blow as I was doing 80 down the highway at night, had no chance to remove any mods. Hiley Mazda of Hurst was good about it -- was all covered under warrenty. Top people!
I would fight hard on this if you are under warranty. Friendly tip -- no yelling/screaming/attitude until you have exhausted all civil options.

Yup. Nissan dealers IMO were way more **** then Mazda dealerships. They tried to void my warranty because i had aftermarket rims on my car , and i brought in for a faulty MAFS.

The evo guys have it even worse. Mitsubishi has systems the scroll the internet and look for users names in SCCA competitions, then just voids the warranty from that.
Can they void for just a catback?

As to the original issue: My book says that "Mazda warrants that the Powertrain Components are free from defects...in material or workmanship which result in improper function."
Instead of "you need a new engine," I would demand that they determine what part(s) inside the engine failed. (If you have a non-Mazda Tech, it might be better to have a third-party diagnose the problem. Further, they might be more willing to be an expert witness for you if it comes down to a lawsuit, since they're already on your "payroll." Get it???)
Once you determine what part failed, then you can go back to the Dealer and ask how the air intake caused, for example, the timing gear to fail? Checkmate!

Flashwing mentioned it before but I had a tech attempt to void my power train warranty when I brought my car in for a 2nd gear grinding issue. He claimed my car was "Heavily modified" and mentioned my vertical doors.
They made the regional Master Mazda Tech come out to the dealership to take a look at my car. He told the tech he was a retard and I kept my warranty. Good news, too, because my motor went about 2,000 miles later.
I now take my car to a dealership that doesn't try to void my warranty, and only one tech gets to touch my car. He owns RX-7's and is a personal friend so I'm good to go with that.

One thing to keep in mind everybody, is time frame of car outage. I was without my 8 for almost 3 weeks, and I borrowed my Sisters 94 Camry. Granted mine was covered under an aftermarket extended warranty.
His best option is to play the political BS game and ask for facts if he starts getting the run around. He's already caught them with a false claim, as the "My Guess" Customer Service rep that handled the MNAO call that the tech at the dealer called for approval or decline, just based the decline because an 'aftermarket' intake was mentioned.
But yes, being civil and asking for detailed explanation on how the aftermarket part caused failure is what should be escalated. With a 2nd review, and the consumer not being the lame duck and rolling over saying "ok i'm screwed", getting them to provided written detail of the void is what you need if they reallly want to push that Magnum Moss act. Going the alternate route if his warranty support option is barred, then the longer legal route which might take MONTHS, in the downtime him having to eat the costs of the repair, provided he can fork over 5-7k after taxes for an engine.

okay , so tomorrow im going to the dealeship to talk with the main corporate manager that owns the dealership and right now i really dont know what to sya first... should i pull out the lawyer card orshould i just fukin keep my cool and jus go with the flow for now.... and also i remmeber he fukin claimed my warranty is voided then all of a sudden when i said why my warranty is voided , he claims its not voided which made me fukin confused as shyttttt, idk what kind of bullshyt theyre pullin on me right now... i went in couple of days ago to take pics of the car and make sure nothing was tampered with... and the only thing that im worried about right now is if they tamper with the car and try to blame something for the cause....[if they are that fukin GRIMMMMYYYy] i really hope ot. my head is spinning as i type bc i swear if this doesnt pull through by tomorrow im gna tell em a court date and tell them about the FRADUALANT DECEPTION...... sO ILL KEEP EVERYONE UPDATED ON HERE AND TELL YOU WHATS GOIN ON TOMORROW.

uhh.. keep your cool. he obviously retracted his void statement, since you didn't role over like he expected to.
Unfortunatly that would make me lose my trust in that dealership.. you may want to hit up another dealer that is referred to if not by somebody on the board, but based on local reviews.
It sucks getting punk'd around like that.

and that would be Mazda of Lodi.
Truthfully they really never ever gave me a problem.. they were pretty cool in the start , like example...[free detailing of the car every service.. and when i mean detail, they literally detail everything. for free.... since it was a new dealership, but now after hasselin me...i dont know bout'em...
