just saw this thread. holy **** that looks bad. as for the driver charging you for the tow - i'd ask him to repeat that request to me in person. he doesn't have to pay any attention to the louisville slugger in my right hand when he does it - it's just there to help me roll my car back over just in case it tips again....

Well look like farmers settlement on the car is 11k which that doesn't help me cause I still owe 17k on the car. By Texas state regulations they are only allowed to pay out what the car is valued at based on similar cars sold in the area. So I have asked to retain the car for its salvage value to either fix or part out , I'd hate to just give away a brand new motor to the ins company with 1700 miles on it. I will keep y'all posted on that.

i was just wondering the same thing... most banks/financial institutions that i have dealt with have required some sort of gap insurance if you owe/will owe more than a vehicle is worth.

sue the tow company for damages and you should be able to recover your losses.
Call a few attorneys, this doesn't have to be all that expensive for you, I'm sure some will take it on contingency and deduct your fees from the settlement. Do this RIGHT AWAY before you sign / agree to anything with the insurance company.

Apparently they only offer that on new cars I bought this used ,not from a Mazda direct user. I asked my INS company about gap insurance and they said they don't offer it. Only the dealer does and part of warranty :-/

ah. i was able to purchase gap insurance when i financed my car and it added like $1.70/mo to my payments. i'd probably go with the lawyer route from here. pretty much any lawyer will give a free consult these days.
