Selling my 8...My story.
Unfortunatly I have to sell my baby . Here is why....Back in November I started going to church. On Nov. 3rd I asked my manager for my Sabbath off(which is Saturday)he said he would have to ask the owners. Not even 5 minutes later he came to me and said I couldn't have the days off. He never called the owners. He never tried to seek any alternatives out. I thought off going to human rights for religious discrimination but maybe there was a different way. 1 month before that someone got layed off in my dept. so I asked my manager if he would bring that guy back and lay me off in his place that way I could collect unemployment while I searched for another job. He agreed with that and shook my hand. So Friday the 7th was my last day. When Monday came around I filed for unemployment. The following Monday I recieved a call from a guy from the unemployment office saying my manager told him that he told me I had to be there on Sat. and I never showed up. So now I cant collect unemployment and I am gonna go through with filing a charge against my previous employer for the discrimination. Thus resulting in not being able to afford my car anymore.

Thanks guys...it's just that I was making just enough money to get by and now I've had to move back with my parents and I have no income and Im burning through my saved cash quick. The way I see it is I would rather sell the car and keep my good credit because I'll be moving to Florida soon and there will be more job opportunities and I can always buy another 8.

Yeah...becuz I claimed unemployment due to lack of work(layoff) and my manager told him that I pretty much just quit. Therefore unemployment says I
made a false statement. I've been reading up on religious discrimination on EEOC.gov and I think I should have a good case. I'm just waiting for them to contact me so I can give them my situation and get their ideas.

Not quite sure what type of work you're into...but jobs here in FL are far and few in between.... just giving you a heads up!!

you can't collect unemployment if your employer claims you failed to perform your duties... sounds like your boss either wanted to screw you or he is a complete moron.

Didn't you get a formal letter to inform you that you've been laid off? If not, you were never laid off...
Hate to say it, but it looks like your boss pulled a fast one on you.

Your best bet is to file a complaint with the EEOC:

If you're lucky you may be able to get a settlement from your former employer. Bringing a lawsuit yourself probably wouldn't be worth it. Good luck in any case.

Detailing? You should be able to find another job man!
When I detailed a couple years back, I never had a problem finding a new job, dealers/ detail shops/ etc always look for good detailers.

Sorry, but you quit. You're not eligible for unemployment.
There is no guarantee in the fair work act mandating days off for religious reasons every week. You are given vacation and flex/float days to allow for a number of days off each year to be used on religious holidays.. just not every week.

Yeah...and I have been doing detailing for 4yrs now. So I have a decent amount of experience. The only thing that sucks about car dealerships is the way the economy is they are all probally pretty slow and no looking for help.

They don't have to automatically give you every Saturday off, but they *are* required to make reasonable accomodations, such as adjusting work schedules, allowing leave to be taken, etc. They can't just demand that you work Saturdays if you have a religious objection, they have to show that they were willing to make accomodations first.

Not to sound completely opposite than everyone else in this thread....
You have bills and responsibilities that require steady money. You quit your steady money before having another job/unemployment/etc. Your choices put your where you are now, not your manager.

Yeah I should have got a layoff slip but I figured I was doing him the favor by not taking it to court...So he should of held up his part of the deal now if I do win a case it could result in him losing his job, then he will feel like an idiot.

Thanks bro...and I have faith that God will provide for me...even if I have to go back to the bottom first.
