Some STUPID X!!
some stupid lady hit my car today!
as i was driving to eat, i was driving on a 2 lane local street. i drove pass a Chrysler 300, and i just kept driving straight on my lane. all of a suddent my gf who's yelling at the driver side rear seat, she yell then i felt the car next to mine hit my car. i was just like what the heck!!!??? how could someone hit me while we're driving straight. after that, we got out of the cars and copied each other's informations and thatz it!
but the thing that hella pissed me off is she acted like it wasnt her fault, she was all like "what happen? i was driving in my lane." and obviously she wasnt. it left me a fat white scratches on the driver side of my car! and there is some minor scratches on the lady's car but no noticable!
now im worry about whoz fault will the insurance company think! i already have a lot speeding tickets, i dont want any more points on my record.
what chances will you guys think the insurance company is smart enought to know that itz the lady's fault?

yes... you should have called the police and filed a report. now its guna be tough. its guna be whatever you say versus whatever she says. since she acted like she wasn't doing anything wrong she may say you did something. at which anything can happen.

Always, Always call the police. Without a report your up crap creek with a paddle made of
crap. You can even file a report with their insurance company and send the pics with your phone. That's what I did. Hope she is honest but odds are against you. Now if it happens say in a Walmart parking lot, police won't file a report so always park as far as you can away from boneheads in parking lots.

dude...we did call the cops, we called 911, and they were like, if no one is injured, they are not gonna send a police out! and i was like.....is it for real? i could make some injury happens!

I had the same sort of thing happen a few years ago when I lived in CA. The police don't even show up unless there is an injury....so my insurance company and theirs fought it out, and they were finally found to be at fault. It took a while though....I took a bunch of pics of the street and where the accident happened, and wrote out a real detailed description of what happened for my insurance company. It was a pain though! Good luck!

let's be honest here guys. even if the police had shown up, it would be the same story. if she was playing dumb with c41250n after it happened, do you think she would have come clean with the cops? it would have been a he said, she said deal there too and since it wasn't an intersection to more clearly show who was at fault, we still have both drivers saying they were driving straight. obviously that wasn't the case and i hope you win this one but i have a bad feeling you're in a 50/50 insurance claim.

What really sucks is that I'm willing to bet there were other people on the road that saw what happened, and none of them stopped to see if everyone was okay, or atleast say that they witnessed what happened.

I'm a female and I agree, most woman can't handle a bicycle, let alone a motorized unit. What's realy scarey is that now all these housewives want to drive these huge SUV's that could hold their own with a tank!! Outta be some laws out there!

Dude, file a report. Dont call 911, I'm surprised you didnt get a fine for calling an emergency line for a non emergency...
Go down to the cop shop, file a report, bring your GF and get her to do a statement.
You have a witness, the other lady didnt. Call your insurance company right away and tell them what happened.
Good thing no one was hurt, and your 8 faired well... it could have been ugly!

The same thing happened to me in my 240SX, almost exactly, damage looked almost the same (guy was changing lanes and just didn't even look to see if anyone was in the other lane). Portland police also don't respond to accidents where no one is hurt and both cars are driveable. The guy that hit me acted like it was my fault and I was worried too. When his insurance came and looked at the car he could tell that I had been hit, not the other way around and all turned out OK.

Depends who your insurance company is bro. Alot of times they will not side with you if it means they get to jack your rates up a bit. Companies like Geico, Progressive, etc.
The thing that you got goin for you is the damage. Her car shows no signs of scrapes or damage. Granted it doesn't prove anything, they will see that and instantly favor towards your side.
What you have against you is the bad driving record. Cross your fingers.

First: Sorry about your car, man. That's a bummer.
Second: You are screwed. You'll need an impartial witness in order to prove you did nothing wrong. That woman could say anything to your/her insurance company and it's extremely unlikely that she's going to admit she was at fault given her demeanor at the scene of the accident. You should have tried to get someone who witnessed the accident to give you their contact information so you could get a statement from them after you file the accident report. As it stands it is now your word vs. hers and generally speaking the end result of that will be you are responsible for the damage to your car and she is responsible for the damage to hers.
You might want to try posting “witness wanted” signs at/around the scene of the accident to see if anyone comes forward.
