i know right, her car is totaled im sure too, she had a 1997 toyota 4runner. i already got an attorney so im going to try and get some extra money from her

The insurance company will have to pay off any liens against the title...ie your loan before they will pay you anything. If the cars worth 14K and you owe 10...you get 4k in your jeans for a down payment ( or whatever )

Honestly my accident that totalled my mazda 6 was the reason I got the 8. I still owed on it, but since it wasn't my fault, and I had full coverage anyways, I got the whole car neatly paid off.

Your lien holder (the place you owes money to) will be the first "party" to get the money. You're the second.
and yea if you still owe the bank 10 grand, u will get 4 grand back. (if thats even how much its worth, most likely much less)
how they know how much ur car is worth ? it's an average of the 3 most recent "private party sales price" of the same make, year, and model in your area.
you might've added a lot of customize part to your car and it "should worth more than market value", some insurance company offers an "optional" coverage for those items, but you have to tell them in advance of how much does it worth, and you MUST have the receipts in case of the accident(to prove that those items actually worth that much) it usually doesn't cost too much to cover extra aftermarket stuff. as long as the insurance company offers the extra coverage, I know Progressive offers something like that. while GEICO does not.

You guys seriously dissapoint me. You will get what the car is worth. And if you owe money on the car, pray that you are not upside down, because you can try to get more but unless your attorney is doing this for free or you have lots of money to pay an attorney to fight an insurance company that has huge and deep pockets, you will end up on the losing end of this.
And seeing what a lot of you guys are writing, I am not so sure about the integrity of this board. Sounds like most of you are a bunch of children.
Have integrity and get what you should. If you are injured and require medical attention, then get it. But just remember karma is a bitch and it will come back to bite your *** HARD if you like to sling crap around.

hey guys i have another question, i just found out that im still covered by my gap insurance
i havent had time yet to call them. but i was reading online and it says that im entitled to what i paid for on my rx8. on the contract it says 23 grand and some change, i was wondering if this true?thanks guys

no, gap will cover you for the difference between what you owe and what its worth. If its worth more than you owe, then you get nothing. If its worth 10 and you owe 14 then it pays the difference to the bank that you have the loan with to insure they get what is owed to them. it covers the "gap" between what you owe and what its worth.
