Hi.
I have this Mazda RX8 since new. In perfect shape. Engine has 70 thousand miles. Body in pristine condition. Always garaged with roof.
When going public places I would park far away, keeping doors free of dings. Always a rotary enthisiast I love this car. Waiting for the next rotary which we know is taking too long.
Recently put Racing Beat Sway bars, Was about to go for full suspension upgrades. Interior is like new. Took it to Mazda dealer about 3 mos ago for a tune up just because needed new coils and wanted an honest assessment of condition from a rotary place aside from private places. My car I was told was in excellent shape. Have the paperwork, was told this e gine was the best engine seen for a car this old. Good maintenance and oil changes pays off.
Well....until August 17 when an idiot using a phone rearended me and could had killed me had I not been able to see it coming. I was in the freeway, here in So Cal. Traffic was stop and go. On left lane. Frist lane was the HOV lane. Second lane was my lane.
I was there on lane 2, traffic came to a stop. Kind of long stop, more than half a minute ( counting 30 seconds or more is a long wait). When I decided to check on the rear view mirror to assess conditions and probably change lanes (I was in no hurry then, which is bad, otherwise I would had moved out of there sooner) ...saw on mirror a white SUV Lexus at about one block distance, but at hi rate of speed. On my same lane.
I looked at it and thought.....this car is moving way too fast...it has to change lanes or else slow down.
It kept getting closer, I was the last car on the lane of stopped cars, nobody behind me. It was coming fast, but the HOV lane was clear, as well as the lane on my right, but I was boxed in, needing to get car on reverse before being able to pull away.
Kept looking and soon it was apparent car was not slowing down nor giving any indication it would change course.....it was an ugly feeling....it looked like a misile coming at me and I was a sitting duck !
So I did all I could do. Braced for impact. Put my foot on the brake pedal, feet firmly on floor, and arms firmly holding wheel to avoid being thrown over onto windshield
SUV never used her brakes, no tire skreeching, no tire marks on pavement. It hit me at full force, probably going 50 or more.
Arms and feet held good. But my head went forward like a rubber ball. My neck felt like stretching, in slow motion, while I was thinking.....face hitting steering wheel.
My arms like mentioned held tight, so I never hit the steering wheel. but at such force your neck muscles can not stop your head from moving forward. Initially my head went backwards, against seat head rest, soon after forward, upon hitting car ahead of mine, although I had my foot on brake pedal.
5 cars total, 3 ahead of mine, and the one that hit me behind.
Nobody is going to do something this stupid, having space to run on both sides (lanes ), with plenty time to decide, or slow down, unless they were using phone to text or what have you.
My neck is messed up. My car is totalled. Insurance company for this woman wants to pay me 6 thousand dollars.
I got an attorney and the case is moving on. I am not going to accept 6K no way. I never wanted to sell my car, I was happy with it, and I am not going to leave my sports car to jump into a Nissan Versa just because.
The front bumper is dented. But damage did not go beyond it (thanks to using brakes and not being thrown over cars had I not seen car coming from behind and getting hit unsuspectingly.) Rear is bad. Trunk and side panels are gone. But mechanically it is good as ever.
Like I said, not interested in being not only injured and aggravated, but will not get scammed. So my plan is, if possible, to get a good RX8 with a broken motor, and pass my engine and good things. I will not accept 6 K. I will find a way to keep driving an RX8 My car with a donor body will do it. Later on, as case moves forward, I will get due compensation.
Fixing my RX8's body would be costly and the salvage tittle would take away any value.
Any advise would be appreciated.

Get her for all your medical bills and pain and suffering too. That should give you enough to do whatever you want. Any good accident attorney worth their salt should get you money in the five digits.

Get a good lawyer, you will get enough to get you a nice 8, I got my 09 GT last year with 12k miles for $13k so there are nice ones out there. Make sure you get paid for your injuries, that is where your compensation will come in to replace the car. Good luck.

It has been a while but it is the valid and only thread about my car.
Well, insurance company wanted to pay $6K for my car. I said no way.
Case is good, police report and all is in my favor. But insurance Co wanted to low ball me. I said no way, for 6K I'd rather wait for the judge
Kept my car in my garage and waited. The Insurance Co used RX8 cars from Nebraska as basis for their appraisal. I told them that with all due respect, cars in Los Angeles, CA go for more money than what their Nebraska prices appeared to be, and I would not accept it.
Sent them examples of cars for sale in CA, with similar mileage and conditions as in my car.
A couple weeks ago received a call from adjuster. They claimed they fired their former appraisal company in favor of a new one, and now they were using CA samples. They offered 12K.
Much better than 6K. So I took it (this is only for car payout.)
Knowing my car, its good engine and all around condition, I investigated. I could spend all that money looking for the latest RX8s, the 2012, 2011 ones. Most at about that price have the same amount of miles mine has
Would be already a 5 year old car. My hopes for a "bet my life on it" deal are set on the hopeful 2017-2018 new RX7. So taking all that into account, decided on fixing up my RX8.
Yes it was totalled, because repair as estimated by insurance was about 85 hundred. Checked car conditions and the front bumper was totaled, but nothing behind. Because I was keeping my foot on the brake pedal at time of impact. That is good.
On rear, suspension and frame were not compromised, because taller Lexus hit my car on the trunk. Trunk lid is a goner, trunk floor buckled, rear bumper, but it is repairable.
So I decided on fixing car. At a very good shop, cost would be 5K. Good thing is, like said before, I had this car since new, engine, A/C, suspension, all is in great shape.
So this is where I am now.
Thinking of , once on road, getting some nice suspension. Already got Racing Beat sway bars.
That and perhaps some nice wheels/tires if I could find info on the right sizes /backspacing.
Yes, I know it would be marked as a salvage tittle. But I like rotaries and this would be my ride, not doing it for money.
Given depreciation expense, I am not concerned.
Glad I waited. It is a waiting game with these insurance companies.
Had I accepted 6K it would had been a rip off. Still I have other issues like having been deprived of my car for so long, and physical injury, but that will be dealt with the law suit part.

Took the opportunity to blacken the otherwise chromed emblems. <br/><br/>Remember my former 1981 RX7. It had black chromes from factory and it looks much much better luke that. 😊👍

My injuries are better. My neck is back to normal. But there eas disc damage although not serious. But damage and those cervical discs do not improve ever.
That part of the case is moving on.
Car drives great. Rear hit only crashed the trunk. The frame and suspension not reached nor damaged.
Like the bumper with the new look. Looks different and more shapely with black section same color as car.
No wonder why the Gen 2 did away with the black lower color. The black section cuts away from the rest of bumper. Not harmonious
