Angry Warranty Help

Hey Guys, i have a question that needs to be answer and i know you were the guys to talk to about it. Can the Mazda people deny any of my coverage under warranty if they think that the cause of the tranny going bad was driver error? They checked to see if there were hot spots on the clutch and they could not find any. I dont drive my car hard what so ever how can they try and pull this ****. They have no proof they i have ran it hard other then i am 20 year old guy with a fast car. This seems ridiculous to me. They have had my car over 2 weeks now and have not done one thing to my car to fix the situation that it is in. i guarantee you that if i was a 30 year old takeing my Mazda into that shop they would have fixed it no problem. If you guys could help me out that would be wonderful.

You're going to have to go in there and remain calm. Explain to them your driving style and ask why they feel driver error caused the problem.
Stay calm and be polite. If they continue to jerk you around I would suggest finding a cheap lawyer to draft a letter on your behalf asking for resolution of the issue before the courts have to become involved.

If the Tranny went out, its not driver error, they have to replace it, unless you modified or changed it out your self.

But if it goes out just from driving even if your heavy on the clutch they still need to replace it. Don't let them push you around they pay nothing to have it replaced.

Well, it depends on what is wrong.

What are the symptoms you're getting?

What does the dealership say is damaged? None of this "you were driving it wrong" bullshit. Are the syncros shot? Are your gears missing teeth? is the throwout bearing shot? or has the clutch plate just worn out?

As it was explained to me, barring gross mistreatment like shifting without using the clutch or putting it in reverse on the highway, the only thing thats not covered under warranty is the clutch plate itself, as it is considered to be a consumable part.

You need to back them into a corner. Make them say what parts failed, make them explain how they think your driving damaged it, hell, demand to see the damaged part itself if you think they are making it up.

Stay cool! I cannot stress this enough. Be polite and reasonable, but don't let them give you non answers. Getting angry and yelling doesn't get you anywhere but on the dealers **** list, and thats never a good place to be. The guys at the dealership aren't much different from you, and they are just as inclined to give an ******* a hard time as you are. More often then not, when dealership people are acting sleazy its because management will fire them if they aren't.

If talking with the dealership doesn't work, you can also contact Mazda directly. Give them a full rundown of what happened, how you were mistreated, and that all you want is your car back in working order. Again, staying cool here pays off. People aren't going to believe a profanity laced, half incoherent rant. If you come off looking like some poor schmoe who took his car in for routine warranty work and then got blindsided by bullshit, people are far more likely to help you out.

Finally, if those options don't work contact the BBB, and see what they say about it. Follow the same steps you did with Mazda. Do NOT go to the BBB first, however much you may want to. Most dealerships make you sign a clause that says you will try and work it out with them before going over their heads. If you respect that, it will strengthen your case.

I just got an up date what is going on with my car. They say that they will fix my car this time but the next time i bring my car into Mazda service that it will not be covered under the warranty anymore. What should i say to this?? Help me out guys.

they are full of **** and can not take your warantee from you........you are covered for the full age/mileage from when you got your car

If it was a problem with grinding gears, especially the 1-2 or 2-3 shifts, then you may have a failing clutch pedal assembly. The symptoms are a notchy feel or clicking sound in the pedal action. This is a result of the spot welds that hold the bracket together weakening, at no fault of your own, and pulling apart. You guys have heard me point this out enough that I am surprised you didn't tell the OP to search it.

To check it, crawl under the dash of your car and push the pedal with your hand while shining a flashlight at the rear of the bracket where it bolts to the firewall. If the welds are weak, you'll see it 99% of the time.
