Care to explain what happened? Was it flooded..?

ahh long story i have had the car for about three months now and i was driving down the road and the gear box locked it barley went into fourth. i bought the warrenty from the dealership for five years 100000 miles i come to find out that the person before me could not drive he swaped one trasmission before i had it and had beat the **** out of the new one. they are saying that i beat on the car and did not take care of it because it had grinds on the gears and the front tires were balding. the funny part is they put new tires on the back when i got the car and they told me that me beating on the car was why the fronts were balding so dumb this dealership does not even know that it is rear wheel drive lol ahhhhhhhhhhhhhhhhh so they are trying to void the warrenty and i think i am going to have to take them to court ..... and to answer the question the transmisson blew
