first of all sorry to hear about all this harry, glad to hear you're ok, but if you need someone on the brute squad to bbeat the cash out of him im your man
bail is not a fine, its a security collaterized by the presence of the defendant at the trial. A crime is allegedly committed, you are suspected, you are indicted and bail is set at $100,000. You can stay at the jail till your court date or someone can put up the $100,000 and you can go home until the trial. If you don't show or flee the country the bail bond is considered forfeit to the state/municipality/etc (along with the additional criminal charges for fleeing). If everything goes fine the bail is returned regardless of whether the defendant is found guilty or not.
im not sure if this is even possible but is it even legal to ask the judge to add the price of the repair/replacment of your car and your medical bills to his bail? that way the city still gets paid for what it is owed and then you get a replacment car/free medical? i dont know if this is possible/legal but it popped into my head and seemed reasonable

Always. I never let passengers sit in my car without a belt either. If anyone was in the car at the time i got slammed and didnt have a belt on... it would of been game over.
Oh and yeah... i was really impressed by how it crumpled. The interior cabin is solid.

Glad your okay man, I have lost a close family member because of a drunk driver. Unfortuately the way our civil / criminal system works, these bastards dont get near enough jail time as they should. If you pursue the case in a civil suit, expect years of legal battles. After its all said and done, its hardly even worth it atleast here in Canada. Its been 3 years now and we just finished up on the criminal case.
But like some of the other members said before. A car can be replaced your life cant. So consider this in it self a blessing.

im going to talk to the DA to insist i get to speak before sentencing. Hawaii is WAY TOO lenient on criminal justice, so i dont know if its going to help or not... but i want to make clear to the judge my feelings. That guy should not have ever been on the road, and he made the concious decision to drive that night when knowing how completely drunk he was. The way i see it because of that... he made a conscious decision to hit me. If he had killed anyone, that was a decision he decided to do. He isnt 4 years old, he knows what drinking and driving does, and he should be punished justly.
