If I were you I would get an attorney. Let them deal with the insurance company.
Plus they will get you some money for your trouble/injuries. You wll be a lot better off. An attorney will cost you nothing. He will get paid from the settlement that he gets you. Take my advice and call one. This is what they do for a living. No need to get the shaft from the other guys insurance company. Because thats what they'll try to do to you.

I'm so sorry man. I definitely feel your pain. I bought my car brand new 4 months ago, and stuffed it into a chainlink fence... destroying the entire front end and scratching the right side to the tune of $12K in damages. After replacing half of the car and painting 80% of it over, I picked the car up last night, and to my disappointment it's completely jacked up. The steering, suspension, lights, paint... all need to be fixed AGAIN.

As I've said, I bought it 4 months ago, but have only driven it for 3. I have 4700 miles on her and she's already a mess. BRAND F'ING NEW. Needless to say, I'm still mildly angry and depressed. I know its just a car, but it's my first "nice" car that I have bought myself as a little "good job at work" gift. Too bad I had to go and F it all up.

I don't this is totaled. Alot of the parts can be 'hammered' out. Insurance will write it off if the repair cost > 1/2 price of car.

am sorry to hear about this and good to hear that u weren't hurt. accidents happen, and yes- it totally suxors. but, it's just the a risk we all take every time we get behind the wheel. every driver has their good & bad days and we're all human. when other ppl hit u, it's really just the luck of the draw. the single most important thing is that no one was hurt.

repair/ settlement wise, i think it all comes down to how much time & $ u r willing to accept.

a good body shop will make your car good as new on the outside, tho inside the trunk u might still see some lines or traces that remind u of the accident. the truth is, ur car is never really ever the same once it goes in for any kind of body work. (in my opinion.) BUT, that doesn't mean that it's the end of the world, and it doesn't mean u won't still enjoy the car once it's fixed.

if u have a reputable insurance company, see what they say and see how fast they are at settling the claim. getting an attorney will get u more $, but it will also draw out the process by at least a month or more, because they'll make u go to the chiropractor, take statements from the other side, take statements from u, from witnesses etc. etc. etc. i think most of us would just be happy getting our car fixed and getting back to square 1 rather than prolonging the process just to get a few extra bucks. but, it's all how u want to handle it.

Thats how i look at it as well, The Insurance adjuster is supposedly going to estimate the damages today and should be getting a call asap.

Really just time and patience sets in to play now. Yeah it sucks, yeah i was pissed as hell but i realized, i'm fine, i didn't get hurt and me being mad is going to magically bring my car back or change anything so i'm more relaxed now.

Lastly, when i looked at it it doesn't look like it tackled any suspension what so ever besides the axle but thats not as bad as a front end accident, so if i do get it back it should ride any different. I actually made them tow it out of town to my body shop i always deal with that most the time to an incredible job so hopefully it should look almost as "new"

ouch.. that does make me cringe... i hate to see that happen to such a young car.. i think i'm going to start taking my turns faster to prevent this since the 8 can handle it..

Usually i do take turns faster know problem, but it snowed the night before not to much, but that morning i was driving cautious and you know the 8's on wet pavement, so i turned slower then usual, maybe that was my mistake to do so but I wasn't trying to slide out just so the people behind me didn't have to slow down you know!

No dude, this wasn't your fault in any way. The rule of thumb (at least from the law's perspective) whoever rear-ends you is 100% at fault. You have every reason in the world to be concerned about a depreciated value. This new of a car, I wouldn't accept anything less than a brand new replacement. If they do not cooperate, then seek council. Until then, a lawyer is unnecessary. Since you weren't hurt in the accident, don't expect any big settlements.

Sorry to see that dude,almost the same happened to my 8,only the right rear panel and bumper and it was over $4,000 lucky me the other guy had insurance.The car was fixed without removing the rear panel,using the same one.Its look like its never been touched

Update!

Will be getting it back mid January!

They were mistaken the frame was left un-touched, so its all body work, and that quarter panel is just a piece that can easily be re-welded. 7k in damages, mostly body work and bent axle. No need for attorneys I'm surprised how this Insurance company handled it in timely matter. I'm just glad i was able to bring it to a body shop i trust! Once i get it back i already have some parts you guys will just have to wait and see!

So i'll still be an rx8 driver =)

Doubtful... i had a somewhat similar hit same side too! What they did was the cut the frame right around the door then welded the piece there.. i had to replace that quarter panel area... the trunk.. the rear bumper and the frame was also damaged. I can't remember the cost off the top of my head... but it's fixable. Doubt it'll be totaled.


I am going to give you a heads up to make sure they seal the trunk correctly.. i had issues with that and had to take it back. It was leak into the trunk and it smelled really humid in the car and the rear window would also get wet. Also the interior of the car at first smelled like paint for the first couple days.


GOOD LUCK! I hope the insurances don't take as long as mine has... it's been over 3 1/2 months and i'm still waiting for them to settle.

I doubt it's totalled, and if it's not totalled I doubt you'll get a new car "just because." Most insurance companies are pretty easy to work with when their client is 100% at fault in my experiences. Just give them a couple of body shop estimates that are on the high side (basically pick the best damn places out there) and stand your ground. Their client has inconvenienced YOU, not the other way around. Stick to that and make sure they give you a loaner car.

In most cases the damage has to be between 50%-75% of the car's value before totalling the car out is even considered. In my state it's 75% so on a newer car you really have to mess it up to even have a chance of it.

Just find yourself a really good body shop and let them do their work. Make sure the body shop offers a lifetime warranty, though, so you know you're covered. When I rear ended a Mercedes in my '06 Honda Civic Si (the car I had before my RX-8) it was $14,000 in damage. It took 2 months but I picked the best damn body shop around (after all, all I pay is a deductible) and when I picked the car up it was better than it was before the wreck! No paint runs, no poor fitment, no rock chips, no anything! The paint matched perfectly and the car never had a single issue.

As long as it's a good repair job the car won't be any different assuming you get over the fact that it's wrecked, and as long as the wreck doesn't show on Carfax (or something where everyone can see it was damaged) it shouldn't lose any value either. Losing value isn't something I'd worry about, though. You drive an RX-8. The car depreciates faster than you can make the car payments.
