im confused because you sent me an email to pay you? then I did last as soon as my paycheck cleared....

then you sold it to another guy?

right now paypal is holding the payment ... I had no idea why ... I guess thats the reason...

I wish that were true, but unfortunately, PayPal always sides with the buyer because it costs them nothing. They just negate the transaction and deduct the money from the seller's account plus a significant fee.
This is why I don't use PayPal anymore if I can help it. They offer no real protection to the sell, despite their "agreement".

The absolute best possible outcome a seller can hope for in this situation is that a dispute with the shipping company comes out in their favor, which won't happen with a confirmed delivery.

as a seller myself, i can tell you that that's not true (in my experience). i've been burned before for not having adequate delivery tracking and now pay ridiculous amounts to ship fedex when i could ship usps for literally 25% of the cost, just because they have reliable tracking, which has helped me on a few occasions.

if anything, it's the buyer that has no protection, unless buying through ebay. once the money is out of the seller's account, even if paypal decides for me, there's no way to recoup. thats why i acted quickly before the money was gone.

I have had quite a few transactions where the buyer received the item, I have a confirmed delivery tracking via UPS or FedEx and then found myself on the receiving end of a "not received" claim resulting in PayPal allowing the CC company to reverse the charge.

I lost close to $8000 over 2008 and 2009 to this.

They do so unilaterally and with no accountability. The official stance from PayPal was "sue us".

that's unfortunate to hear. i do know that paying by CC definitely makes it a lot easier for buyers to scam, as opposed to those that fund via bank account.

NOTURX8, i am closing this dispute for now. hopefully getting my money back will be as easy as MazdaManiac says, though that's not been my own experience in the past. i hope i don't end up regretting this decision...

i have not heard a peep from this seller since closing the dispute. i see he checked his PMs yesterday morning, but didn't seem to want to respond to me then, nor to any of the other emails sent to him yesterday. lovely
