wow no money? lol last I checked small claims court was only $75.00 and if they want to hit up a more expensive court and drage it out and now you want to pay someone by the hour, you can sue them (well your still proving your case) for what its running you or simply ask the Judge or court that they fit the bill for the court. If they think its fair they sometimes do it.
So lets think of "Magnuson Moss Act" like a speed limit sign? uhh no. That wont get you anywhere. Stick it in there face.
Just like my friend tells me about people like you and me that have after market **** on there car and when its in a wreck ins co. just tell them; well tuff **** you lost it and they eat it. Wrong.

You can't take it to small claims the cost of the repair is over their limit. So the only recourse would be to pay a lawyer couple hundred an hour to try and sue Mazda who has I don't know how many millions of dollars than me who could easily make me go broke trying to get an engine, while some Judge could just agree with them and then I'm fucked and could have spent that money towards and new engine. That's why I stopped fighting cause there is that chance that the Judge just wouldn't see it my way and I'd be out an engine and a couple grand. That sounds worse than having no warranty to me.

Oh and sticking the Magnuson Moss in their face or up their *** doesn't even make them flinch. They don't care.

You would be surprised how much a different personality can get from a dealer. I wouldn't be surprised if a dealer dumps on a 20 year old guy because they assume he can't defend himself. However, the tune often changes when they are dealing with someone who presents themselves with a strong background, life experience, and a knowledge of the better business bureau. Sure, MNA has a pile of money, which is why also don't care about replacing your engine. They have replaced a heap of Rx8 engines under warrantee. What is one more? Ultimately, the dealer shouldn't really care either. He gets paid for the service by MNA. I doubt MNA is going to stir their legal department over your engine unless it's a slam dunk case.

Well with me they just told me to put my stock cat back on and they will fix it an I'll keep my warranty.

Well it turns out I did get 'lucky'

they decided my a/c drain being clogged was not warranty (new car 12/12k for a/c coverage) and then they tried to tell me

"the entire dash, and evaporator has to be removed and the parts and labor is about 1400 dollars"

I asked him are you sure you cannot just drain it w/o removing all that? He says to me "only other way is to remove the transmission"



What a huge load of horse ****. I should have expected this, 5 minutes later I'm on the phone with a local a/c shop that will drain it for free and confirmed that there is EASILY an access point to drain w/o removing a god damned thing.

oh yeah, the 'lucky' part is, as soon as they realized they could charge me for the POS mazda3 rental they completely forgot about the transmission issues

Dude I am not laughing at him making a mistake. I am laughing because it is something I have faced as well, and if you don't take it with a sense of humor it'll kill you. Have you checked your "duckbill" drain for the AC? Many people have had theirs clogged. Search "duck bill" or "duckbill" for the fix: coat hanger and silicone spray.

The more important issue at hand is who is Bose's avatar of and where can I get the full size pic? Also important is that Bose is right. My fight with Subaru lasted over two years! Luckily my lawyer gets his fees from the defendant when he wins. I didn't owe him a cent. Paying for it yourself is a sure fire way to lose and be out $$$.

You obviously didn't take it far enough, I got a new tranny from Mazda under warranty after they refused to warranty it for two weeks. I paid a lawyer $100 to send a certified leter to the regional rep stating his intentions to file, the next day I got a call saying they will cover the work and any rental fee's My friend is a regional service rep for Honda on the west coast, he run's into many moded warranty claims, especially on S2K's. He told me that Honda has them drag warranty claims on modifications and other things as long as possible, hoping that the owner would just get tired and give up (like you did). He said once he gets a certified letter from an attorney they go ahead and approve the work. It costs the manufacture to fight these claims, most of the times it's cheaper to pay for the repair. The only time he sticks to his guns when it's 100% obvious that the mod caused the malfunction. In these cases no lawyer will take the case anyway. Also keep in mind that some attorneys will take a case and only get paid if you win, though they take 1/3 of your winnings. Obviously they only take cases they know they can win.

In short, just stick to your guns if you know for sure the rep is full of it. If you turboed your car and blew the engine then deal with it.

I am glad someone would have suggested this to me at some point anyway, thank you. I actually found out in a drunken stupor last night when I searched to see if anybody else had run into this

I bumped that thread as well (it is in the tech garage) just in case another stealership tries to tell someone that they need to pay thousands to drain the a/c

The other reason I gave up is my car is still running no loss of power, I know I should have probably paid to have a lawyer send them a letter but I didn't even know where to start, what kind of lawyer handles this?

I know for a fact if I wasn't a long haired 23 old year kid they probably would have helped me out more. I wasn't rude at all,but I'm sure they saw me and just figured "ahh **** this kid doesn't know ****, his parents will pay for it" And just said your fucked.

i brought donuts for the service guys at Alhambra Mazda once. and, that still didn't prevent them from scratching my car door... the weekend crew there seems slightly better though...

either way, i hope they dont' notice it and still honor your warranty. <fingers crossed> keep us posted..

QUESTION : does intake relate to transmission problem ..? i think not but just to make sure , im asking u guyz ....i have K&N v2 and i have gear grinding problems ....if its related , i'll just switch with stock intake....troublesome but i'll do it ~

It was a friend but you can ask any small lawfirm to draft you a letter and send it via certified mail. They may charge you a $100, easy money for them. If you really want to pursue it just look in the yellow pages and start calling.

last time I was at the dealer they tried to give me crap about my warranty... they were saying that my ECU failed cause I have nitrous... I politely explained that I was not spraying the nitrous into the ECU like most people do, and in fact had installed it into the intake. They then proceeded to tell me that it was still the cause but could not explain how. They said they would have to ask mazda to clear it as warranty work, they called back and said it cleared. I got my new ECU.

I was also having my fog light looked at because it has a leak or something which has caused 2 bulbs to go out. I had them replace it once. Then I switched over to some hoen bulbs. When I had them checking into replacing the light housing, they told me that it was like that because of the bulbs I had put in. At that point I was just ready to get my car back and said to not bother with the fog lights. Next time I go in, I'm calling BS if they try that again.
