Help!sold wrong warranty, have bad engine. What do I do?

Unhappy Help!sold wrong warranty, have bad engine. What do I do?

Car problems. I need your help. So I purchased a 2004 mazda rx8 in April 2010. Car dealership sold me a power train warranty. 7 months ago car started stalling and not starting. Took it to mazda dealership, they changed spark plugs and wires. Had it to that dealership 5x and they claimed the car had been fixed and there was no issues. ($2000 later) still had same problems. So I took it for a second opinion at a different mazda dealership. They claimed the engine needs replaced due to apex seals gone bad. Not having the engine fixed caused carbon build up which damaged the Catalac converter. So it's the other dealerships fault for jot catching the real problem! So I was relieved when it was the engine because at least it was supposed to be covered. Wrong! The dealership sold me a warranty for my car that doesn't cover rotary engines! They claim an apex seal is not an internal lubricated part!!! So now I have to pay $6000! Is there anything else I can do? Is that legal for the dealership to sell me wrong warranty, should the 1st delaership have to pay for Catalac converter? Thanks

Does the "fine print" specificly exclude rotary engines?

I don't know how they say the apex seal isn't lubricated when there are oil injectors that spray the seals, and it is internal.

No, the copy of my warranty does not say excludes rotary engines, and the warranty claims they don't cover seal because seals are not internal. But mine are . I am just so stressed about it and don't know what to do

It's obvious they don't understand how the rotary engines work. You should go online and get diagrams and bring them in to explain how they work. Search this sight for threads talking about the oil injectors and how they lube the apex seals.


Here are two videos you can use:

The oil burning story:
The RX-8 burns oil intentionally. The only way to to lubricate the seals inside the combustion chamber is to inject oil (or have oil in the fuel, called premix). This oil then gets burned under combustion, so it has to keep oiling, and oil keeps burning. On average, you should see about a quart of oil burned every 1,000 miles. If you aren't burning anywhere close to this, something is wrong. If you are burning way less, you aren't getting enough oil injected, and your engine doesn't have much chance of lasting long. If you are burning way more, then either you intentionally increased the oil injection and it isn't an issue, or you you have an oil control ring failure, and oil is leaking into the housing. This will require an engine rebuild to fix, although isn't inherently bad. You will have more oil smoke, you will burn oil faster, but not much else. Let your oil run too low though, and you can fry your engine from being too low on oil.

Keep the oil filled above the 1/2 full mark, letting the oil light come on means you are already critically low. Don't overfill though, since overfilled oil spills into the intake and gums up your intake valving, and can easily cause costly repairs.

Apex seals on a rotary are the equivalent of piston rings on a regular engine. If the dealer doesn't understand the info Tankerg provided, you should not have difficulty finding a lawyer who does.

How many miles on your car? Are you in the US, where there's an 80,000 mile federal warranty on the cat?

Dealership can do anything they want, as long as you agree to buy it.
You should have done research on the warranty company that you were buying coverage from, but you were too busy trying to get the car keys in your hand instead of doing research.

You have two choices now.
Pay for the engine out of pocket, and be truly f'd in the a, or you can get a lawyer, and fight the warranty company and the original dealership for not covering your engine under the warranty. You should at least be able to get your money for the warranty back, if you haven't gotten any value out of it. If they have replaced a single part on your car already, then you're pretty much screwed.
