I crashed my RX-8..Lawsuit suited?

Unhappy I crashed my RX-8..Lawsuit suited?

ok so i was driving my dad's 2004 rx8 and i was doing aggressive driving and figure 8 type private road. I came around one of the turns and i lost total control of the car(possible recall on the lower control arm?). I went flying into the curb at 55MPH and the rear rim hit first and shattered. Then the front rim hit and it shattered. Afterwards the car went airborne and landed ontop of the curb and slid across it. The 5 spokes of the wheel are still bolted on to the disc brake rotor, but the outer rim and tire got pushed into the wheelwell. The A-Pillar and front left body panel, and sideskirt(the area under driver's door) all got bent.

SHOULD THE AIRBAGS HAVE COME OUT IN THIS ACCIDENT?

I have been looking at the recalls for the 2004 rx8 and there seems to be alot, including one about the airbags having wirig problems.
Remember, the impact was so hard that the curb cracked and the car went in the air.


Please let me know what you think?
The main querstion is if the airbags shouldve come out.

Depends on the sudden force of the impact. If it was more of a slide than anything else, then probably not. It takes quite a bit of force to deploy an airbag.

The A-Pillar got bent and the front side impact airbag didnt come out??
I got whiplashed too, i mean thats B.S. lol.

Also hitting a curb and going airborne, I would think that the airbags would come out since the car almost flipped.

Once i get my pics on my comp at home, i will try to post them up on here.

Sorry. I'm generally very sympathetic about crashes and freely give my best wishes for recovery & fixing the car. However, in this case....

you should be more carefull! and sometimes airbags do more harm than good...i had a freind get all messed up by a airbag in a small fender bender accident

Quite honestly the whole aggressive driving thing puts your far out of reach for any lawsuit pretty much.

Do you know where the A-pillar is?

I find it hard to believe that the A pillar got bent without the windshield shattering completely.

Well the car is totaled. It shouldve been able to take this turn as i was able to take this turn all times before. And the car just wipes out. I got whiplashed, saprained my neck and the damn seat belt cut me. Luckily i didnt break any bones but i was damn close. I dont understand why the airbags wouldnt have come out, and it makes me think about the recall because we had frame specialists and mechanics look at the car and they said the airbags SHOULDVE come out. I am still a minor and i couldve gotten seriously injured. I mean i am gonna have it checked for the lower control arm too to see if it cracked since thats one of the recalls.

Unless you can prove that the lower control arm failed prior to the crash, or you can prove that the amount of G's you and/or the car underwent for the impact should have deployed the airbag, then you have no case. Neither will be easy to do.

Even so, I tend to agree with what Silver06 said.

It wasnt severely bent and yes i know where the A-Pillar is otherwise i wouldnt be saying that. I am surprised the windshield dint crack or shatter either, but my mechanic said that it got bent.

did you hit the front end? no so no front airbags deployed. did you hit anything with the side/door area? no so no airbag deployed. read your manual.

ok well im just wondering, im not eager and like in desperate need to sue Mazda.

The lower control arm according to the recall cracks under [I]AGGRESIVE[U] driving. So technically that should mean that driving hard has no problem. Otherwise Mazda should have been more clear in their recall.

BTW we are already in a lawsuit with Mazda for our grinding transmission , and people said itd be impossible and our attorneys took the case Free Of Charge, since that how auto company sueing attorneys work.That is to clear up on the spending a lot of money on attorneys part.

Yes. Your dad should sue you for totaling his car. (I'd disown you if you were my kid.)

The reason the airbags didn't deploy is because you hit a curb, not a brick wall. you need a significant side or frontal impact to set the airbags off. If you hit a wall, or wrapped the car around a lightpost, they would have gone off.

Don't blame the machine. There was nothing wrong with the control arm. This was you being an idiot. Then again, a mechanical defect is probably your only hope for not being grounded for life. Isnt it?

The wheel got ripped off the spoke and pushed into the wheelwell and bent the suspension.

The A-Pillar got bent.
The metal under the drivers side door got bent in.
The front left body panel got bent. The car went airbone.

I would think the the side curtain airbags wouldve deployed especially since i got whiplashed too.

I think you should definitely find a lawyer. Give him/her your dads Credit Card # and tell the lawyer you want to go all the way to the supreme court if need be.

My dad laughed at me for it. He was there and saw the whole thing, because i was driving well. I also drove around this turn several times so i mean dont try to trash talk me. I am just trying to gather information.
And im sorry if you think its wrong im not grounded for life or that my dad isnt sueing me. Sorry im a minor and my dad actually cares for me rather than the car.

You and your dad both sound like a real piece of work.

you beat on your transmission then sue mazda when it starts grinding.

You crash the car, and then try to sue mazda because the airbags didn't come out.
