Question about damaged intake valve.

A few months ago the dealership replaced the motor in my 04 manual rx8 due to lack of combustion. When I got the car back it ran like crap. First of all they didn't have the exhaust hooked up right and then found out they cracked my upper intake when putting the motor back in. The guy who put it in come to find out was a chrysler mechanic. I finally was able to get them to replace the upper intake they admitted that mistake but when I almost had them replacing the intake valve cause its cracked or something (mazda service rep said mechanic also damaged this) the warranty people refused to pay for this cause its an internal part they couldn't of damaged it. But what keeps going through my head is they had to strip the old motor of parts that needed to go onto the new motor. So that means they actually took it out and had to handle it correct? So its possible they could of damaged it? Wanting to figure this out cause about to go to a family friend that is a lawyer and start a law suit. Thanks for everyone's help.

Intake valve?

Do you have a piston engine?

"Lack of combustion" -- I'll have to remember that one

Hey, if it still doesn't work right then they haven't finished fixing it yet; regardless of the cause.

You must mean one of the intake shutters/tumblers?

You are aware we are talking about a rotary?

Yes I know my car has a rotary engine. I'm just quoting what the Mazda service rep has told me. Which it goes to show you how much they know. I've tried making them replace it but they refuse. So.... any suggestions?

Is this an internal part that they would of handled or did this happen on its own?

The shutter valve probably was fouled up by oil overfill. Make sure your oil is below full and check for oil in the intake system. There are threads on it.

The aux port could get damage if the mechanic don't know what he's doing because when he take out the LIM, the aux port is sticking out or you need to take it out before you take out the LIM.
the shutter valve and the variable intake valve is inside the LIM, so they couldn't damage it or they should not take it out. You have to talk technical terms, and ask which valve the mechanic damage, and talk to the claim department about the aux port is sticking out when the LIM was remove.
