The problem isn't in the flash, it is in the WDS and the method by which the dealers receive the updates.

By the way the service guy I talked to today reacted (while arranging for another service visit for them to fix what they have done), they must know what is going on because he wanted me to bring in the car right away and was worried that I would be driving it over the holidays before I could get it in. I did not ask him much more over the phone, but you can bet that I will be asking a lot of questions when I see them face to face.

DO NOT let your dealer put the latest flash in the car until the code issue is resolved..

when I went to get the flash the service guy held up this letter talking about the bug in the software. I was pissed but glad I had not done it the week before like I wanted to.

CEL caused by high rpm misfire
Took the car to the dealer Sat - the flashing was caused by a misfire at 7500rpm. Said the plugs were probably fouled from moving around the lot and test drives. They (North Penn Mazda) replaced the plugs with the upgraded hot plugs
Also checked the version of the PCM flash. The service manager was suprised to see that they have been 'back-flashing' to the L version (he thought it was the M version at first until it was checked).
Either way the car was running great (even with the misfire) and it still is running great. I only hope when/if they reflash the PCM it doesn't cause any problems.

Flashing CEL is usually a misfire and the PCM cannot keep up with the data that is being processed. At high RPM it gets difficult for it to read the changes quickly enough. On the '02 Explorer there was a problem with high revvs CEL flashing on the 4.0L V-6. The PCM was scrambling trying to keep up. I have heard that the PCM on the RX-8 is MUCH more powerful and complex than anything else out of the Ford/Mazda parts bin so I am surprised that there is a similar problem.
My car did the flashing CEL once last winter at HIGH revs after only driving a short time. Misfire code P0401 if I remember right.

ok now I am really confused. When I went to the dealer they showed me the letter halting the update. But now that I have received my services done paperwork in the mail it appears they did it! So does that mean I got the buggy software? I guess I should do the 20 tap test to see if it has been updated but should I contact the dealer. There does not seem to be any problems so far. Im going to go eat a stress brownie while I await your answers.

I got the letter about the new flash and I all ready have the M-flash so is it a new flasg, plus I heard they stopped putting out the new supposed "N" flash because it makes the CEL come one permenatley

Am I reading all this right? The recommendation is to not get your car flashed at all until there is an official release of a new version?
My situation is I have an early 04 that I just bought... It was a showrooom car so even though it only has 2500 miles on it (time for the first service) I believe it was built in dec. 03. I did the brake test and i don't believe it's been flashed at all (despite repeated requests to ensure all TSB work had been performed before it left the lot). So should I ask for the flash when I bring it in for the first service? Or should I just get my oil changed and wait for the new program to come out?

I had my 8 flashed on Nov. 18, yesterday the check engine light came on. I can't get to the dealer until next week, I'll post if the two events are related.

IF they pay attention to the service bulletiins they will NOT flash you at all now until they get the new go ahead from Mazda. but since ht epreviously released TSB said to do all cars even the ones on the lots yours should already have been done. but really its a moot point now since the flash campaign is halted. so just get your oil changed.
