So basically, if you are getting paid for any given piece, or it is being replaced, you no longer have any ownership claim over that piece. You could remove mods from your car, but that will deduct from the reimbursement check.
Again, this is how your insurance company would handle it, if they were the ones paying.
Since the dealer's insurance is at stake, and this isn't "automobile" insurance coverage, but rather "general liability" for mistakes and errors, the rules are probably different. They need to "make you whole" to avoid a lawsuit from you (which you have the legal right to, although I wouldn't recommend it unless they try screwing you), and what "making you whole" equates to is something that will have to be negotiated. Don't just take their first offer, unless it is truly and accurately fair.

You don't have to be nasty with them up front, but they know they have to make it right. They may try to get you to settle for less(that unfortunately is only natural) so that's why we are saying don't take that first offer unless you are 100% satisfied. Even then......you really need to think about it. You can be nice about it until it's time to not be so nice.

the instructions to replace that line comes from the Mazda repair manuel--i dont have.
WHen I went to my parts guy to buy the connectors he told me they dont sell them. He said mazdas instructions are to replace the line and they dont even sell the connectors individually.

Even in the Series 2 RX-8 the Hose is different by Part Number, but Mazda still don't supply the connectors separately...ONLY with the Hose itself..

My engine is being replaced and I am being charged for everything that needs replacing with the exception of the engine core. (engine mounts, belts, etc.) I am currently up to $310. Don't get me wrong its more than worth the cost to get a new engine.

However, Mazda chooses whom they authorize and choose not to authorize to sell their vehicles. I am not saying that the dealership is not responsible but the issue is indeed tied to the Mazda name.

Good.........I think I'd mention this thread and also that the service manual apparently points out NOT to re-use. Don't know if anybody ever real proved that without a doubt though. I'll have to re-read down in the thread some more.

Did you have less than 60,000 on the odo? If you are within powertrain warranty, it should be completely free, if you are outside of powertrain but within extended core, then you have to pay for stuff that needs to be replaced that they can't re-use, but isn't actually part of the engine core. It typically runs $500-$600.

Say the car is worth 10000 and I still owe 7000 that leaves me with 3000. How do I go to a dealership with a car complete with 9000 dollars worth of parts and leave with only 3000 bucks. That's just not right. I can by another 8 but would have to spend another 9000 to get the new 8 to that same condition. That's really not right. I should get the 3000 after paying the bank 7000 and 9000 on top of that. That's what I think.
I'd be curious as to what makes up your $9k.....new clutch? tires? brakes? Those are wear and tear items and you likely won't get anything for your upgrades. Labor for the install of anything aftermarket? Sorry, but my best guess is that you will likely get enough to cover the cost of a stock 90k mile RX8....plus you might be able to fight for a greatly depreciated value of the aftermarket stuff.....but I think that is about it. I'm not saying this is fair, or the way it should be, I'm just trying to give you a realistic idea of the battle you might have ahead of you.

So if you think the car itself (stock) was worth $10k, and then you added $9K worth of aftermarket, I don't think there is any way you would get $19k for a 6 year old RX8 with over 90k miles.

This is flat out liability insurance by a business to protect itself from lawsuit losses. If what it takes to make him whole is to buy him an RX-8 and get those $9,000 in mods installed, then that is what will have to happen.
Likely, he won't specifically require it, but legally, he has that right. Auto insurance applies vehicle and parts depreciation into the calculation. This DOES NOT APPLY here.
THIS IS NOT AN AUTO INSURANCE ISSUE.
It's no different than if a electrician came to your house to make a repair and in the process made a mistake that burned down your house and your possessions. The electrician's insurance steps in to make you whole again, and you have every legal right to mandate that his insurance company replace everything exactly the way it was, and your home owner's insurance has basically nothing to do with it, other than adjusting the insured value after the fact.
The fact that it happened to a car does not make any difference in the matter.

So I looked into the fuel line (13-495) my local tho shady dealership told me the only one showing up was in a warehouse in PA. The tech/parts guy then proceeded to tell me that it must be a rarely switched part and looked at me like I was crazy when I said it was good procedure to change it out. Either way I ordered one, anything else that is good to consider during a swap?
I'll prob be doing a leak test tonight tho to see if the line is sealed at current, tho I'll have the new line in on Thursday.
