P2070 SSV...but tests ok

Ok, so In April, after I returned from the Texas 8, my car had the 6th engine put in. About 3 weeks later, the engine light came on and read out the code P2070 (Intake tuning valve is stuck open). Of course I pulled the code and then called the dealership. I took the car in and they put it through a diagnostic in which they said it all tested fine. Now, I know you are thinking, "Well, of course they said it tests fine, they don't want to have to work on the engine they just installed for free." Negative, the dealership that put in the engine was not Mazda...my extended warranty is only covered at the dealership I bought the car from and they are not a Mazda dealership. So, Mazda would lose nothing by telling me there is something wrong with the car. Anyways, so I took the car in and they said when they hooked their computer to the car, they were able to send the car commands to open and close the SSV. They said the SSV was working properly...it was opening and closing when they told it to. They said all was working great and that they cleared the memory of the car and I shouldn't have any issues.

About 2 days later, the engine light came on again. I called Mazda and they said to seafoam the car since they found nothing wrong with the car and maybe just needs a seafoam. I have now done the seafoam twice. When I do it, it corrects the engine light for about 24 hours at the most. I have noticed, the engine light never comes on when driving, its only when I start the car is when the light will come on and stay on. If I use my scangauageII I have in the car and reset the engine light, it will stay off...until I start the car next time and immediately it throws on the engine light and reads out P2070.

Now, I can take it to the dealership I bought it from where I have an extended warranty, however its a $200 deductible to have it worked on there. I wouldn't mind that so much except they have admitted that my car is the 1st rotary they have ever worked on when they replaced my engines. So...I am not confident that they would find the issue and know what to do once they did find it. I can take it to Mazda...however I prefer to have at least foreplay before I am raped and with their pricing...they just stick it to ya! So now here I sit...engine light throwing the P2070, Mazda telling me that when the did a diagnostic on it 2 weeks ago it tests fine and my dealership that will work on it for $200 didn't even know what the SSV was when they read the code.

I know I could take out the SSV and clean it however I don't think that is necessary since Mazda was able to get the valve to move every time they told it to.

What do I do???

You may have a bad contact switch on the ssv
You may have a bad vacuum actuator
you may have a bad solenoid

Jon316G has some good troubleshooting guides

One easy test is to watch the SSV while a buddy shuts off your ignition. It should cycle once.
Don't forget to test the VDI components as a bad leak there could also cause your code

When they said, "tested OK", what does that mean?

Just this past week, i filled up with Speedway gasoline for the first time in a year instead of the normal Shell. It ran differently the first day and eventually threw a check engine code. It read as P2070 and before i read the code, i noticed a significant drop in power and then all of a sudden full power over 8k. It ran like this the whole week until I filled up with Shell gas again. Code went away and the car pulled as normal and strong as ever. I was starting to get scared I was going to have to pull the engine after reading here that was in order to remove the intake plenum. But she runs healthy now! :D
