Rx8 p2096 again !!

Okay so I had posted a while back about this code and the symptoms I am getting. Well I am getting a new set of symptoms and the light keeps coming back on. This is what's going on :

The light has been off for a while until it recently came back on. It was on for a day then shut off . I drive around another 250 miles and it comes back on , it shuts off again. It seems like there is a pattern here that I have noticed . But recently I got onto the highway after the light just turned off and I made it a mile and it popped on again. I have come to this conclusion. If i keep it under 50 with city driving i will get around 250 miles before it comes on. If I get on the highway it comes on regardless of the miles I have driven . What do you guys think ? Also do you guys think the dealer will take a look at the cat without charging me anything ?
