Got T-boned -- totalled

Well, this sucks. I got t-boned at Pagemill coming from work. 17 yr old spoiled Palo Alto kid with suspended license, and has had 5 major accidents in a year, ran a red light and hit my driver's side. Bragged with a loud voice that his mom's gonna get him a new car anyway even though his license is now revoked.

All five airbags deployed and I got out of my passenger door. Broke left foot and painful chest. I dunno how my left foot took the impact though. I really loved this car, and will probably get it again knowing the kinds of crashes (remember Hardhitter's) it takes and totally saves the passengers.

oh and all emergency people who showed up kept saying "too bad, such a nice car..."

Wow! I'm glad that you weren't too seriously injured. Sorry to hear about the car and the brat. Kid should be arrested for driving on a suspended license. Regardless get well soon and good luck on a new car.

Thanks guy. He was driving a silver Corolla. I dont know about him getting arrested, cops didn't seem to be bothered by his record.

Glad your OK! (as in it could have been worse) And it just goes to show how tough the 8 really is. They should throw that stupid kid in jail.

^ Yeah, I'm starting to wonder how the system excempts certain people from the law. I remember when my license got suspended for medical reasons, I was warned that if I drove and got pulled over or got into an accident, I could wind up in jail. When the cops learned about this kid's record, they didn't seem bothered at all. Even left with "get well..."

pfft... it pays to have the right skin in this society.

Find out when the BRAT is to appear in court and testify against him. Get the judge to throw the book at him. Get him some jail time. That should shut him up and keep him away from that new car for awhile.

What a shame that they let kids like that loose on the street. He could have killed somebody. Glad your OK. Just imagine if you were on a motorcycle instead of being in the 8...

Like everyone else, first off, I am glad you are OK.

You didn't say if he had insurance, with 5 previous accidents, I don't see how he could be covered. My first insurer dropped me after 3 claims in 3 years (two break-ins and a minor accident).

I assume you have contacted your insurance company. If it is a good one, I would recommend talking with them, since they will try and collect from the "at fault" insurer to get reimbursed for their large expense of replacing your car and dealing with your medical expenses.

I would also talk to a good lawyer, the first consult is usually free and figure out what you could do.

You might also have a case against the county for not removing the menace from the road (remember, OJ won in criminal but lost in civil court).

Note, I am not a lawyer. If it were me and I were being particularly vindictive, I would sue the parents, I would have my employer sue the parents (they would have lost my productivity for any time I missed as a result of this accident), since I was covered by Kaiser, and they largely subsidize the costs of treatment, I would suggest they sue.

You did tell me once you wanted a nice home in Palo Alto, didn't you?

A local 17 year old killed a girl in a show off accident (jumping a damn dodge off a small intersection hump). He NEVER has had a drivers license and has picked up 9 Driving Without a License tickets; one a week after the accident that killed the girl. He was released after the last ticket but the court did charge him with manslaughter.
Get this, this winner is out on $2500 bond to be with his 15 year old wife!!!!
He said "I mean, no one wanted it to happen. It wasn't something that someone saw coming. But when you do thing like that you put your own life in your hands. I don't like hurting people or anything like that. Nobody knew it was going to happen."

Nice one Dave. Thanks for the tips! the whole time I was worried about them coz they hit me head on. Chances are, I expected they would get a big smash on their faces. But then I lost all sympathy when that brat opened his mouth in the hospital. He really annoyed everyone there.

Glad you're okay. Some people just like being ******. If he shows no remorse, you shouldn't either in taking him for all he's got. Chances are his mom can afford it.

oh MAN Xyntax, I'm sorry to see this happen to you! You've been on here soooo long, it's a shame that you have to part with your 8 under such circumstances.

I definitely think you should testify against him and consider taking legal action. You've got a broken foot and a sore chest because of him, you deserve to be compensated for that. Had he not blown that light, you'd still be walking fine and driving your 8.

my wife's a claims adjuster for a major insurance company.
You totally have case against the parents if the police report backs you up. if they're rich, they probably have a huge policy. talk to a lawyer.
